Chính vì vậy hàng loạt những chế định về hợp đồng thương mại dịch vụ ra đời để bảo vệ quyền tự do ý chí của các bên. Nhưng song song với đó là làm so để các doanh nghiệp thương mại dịch vụ có thể nắm bắt, tìm hiểu một cách kịp thời những chế định đó, áp dụng những chế định đó một cách chính xác và phù hợp với từng nghiệp vụ của mình thì không phải điều đơn giản. Công ty TNHH RinKi Việt Nam nói chung và các doanh nghiệp kinh doanh mặt hàng dịch vụ nói chung cũng không tránh khỏi được những khó khăn trên trong quá trình áp dụng. Ngoài việc Công ty TNHH RinKi Việt Nam đã áp dụng đúng pháp luật và cẩn trọng trong quá trình giao kết hợp đồng thương mại dịch vụ thì Công ty cũng có những hạn chế như Công ty chưa có bộ phận pháp chế, chưa chú trọng vào vấn đề quản trị rủi ro hợp đồng, cụ thể là rủi ro trong thanh toán và quy trình giao kết hợp đồng thực hiện còn mang tính tự phát, dựa trên thói quen từ trước; không có thói quen sử dụng dịch vụ tư vấn pháp lý trong việc soạn thảo Hợp đồng thương mại dịch vụ. Trong thời gian thực tập tại Công ty TNHH RinKi Việt Nam, xuất phát từ nghiên cứu tình hình thực tế tại Công ty, em đã quyết định lựa chọn đề tài nghiên cứu: “ Pháp luật về hợp đồng thương mại dịch vụ và thực tiễn áp dụng tại Công ty TNHH RinKi Việt Nam” cho chuyên đề thực tập của mình.

Trong thời gian thực tập cuối khóa phục vụ cho việc viết chuyên đề thực tập tại Xí nghiệp khai thác công trình thủy lợi huyện Tiên Lữ, tình Hưng Yên, em đã được tiếp xúc và thực tập làm việc về mảng tiền lương và chính sách Nhà nước về tiền lương cho cán bộ công nhân viên trong Xí nghiệp. Khi được trực tiếp làm việc và nghiên cứu việc áp dụng pháp luật tiền lương tại Xí nghiệp, em đã nhận việc áp dụng chính sách và pháp luật tại Xí nghiệp còn một số hạn chế do chưa nắm chắc và hiểu rõ luật để linh động áp dụng với đặc thù hoạt động kinh doanh riêng của đơn vị Nhà nước phục vụ việc tưới tiêu cây trồng trong huyện. Vì vậy, là một sinh viên Khoa Luật – Trương Đại học kinh tế quốc dân, với mong muốn áp dụng những kiến thức đã được học tại trường vào việc khắc phục những hạn chế thực tế tại Xí nghiệp, em xin chọn đề tài “Chế độ tiền lương: Pháp luật và thực tiễn áp dụng tại Xí nghiệp khai thác công trình thủy lợi huyện Tiên Lữ3, tỉnh Hưng Yên”. Chuyên đề hướng tới nghiên cứu toàn diện các quy định của pháp luật về chế độ tiền lương, từ đó có những phân tích, đánh giá đối với việc áp dụng pháp luật tại Xí nghiệp cũng như đưa ra một số giải pháp nhằm hạn chế và hoàn thiện công tác áp dụng pháp luật tiền lương tại Xí nghiệp

Since the Doi Moi policy of economic renovation was introduced in 1986, Vietnam has undergone deep transformations as a result of the transition to a socialist-oriented market economy. Social and urban transition has taken place in parallel, as urban dynamics were spurred on by Vietnamese public and private stakeholders, and by external agents such as international organizations and international solidarity organizations, experts, consultants and bilateral aid organizations.Here are the results of research carried out by French, Canadian and Vietnamese teams from the north and south of the country on the overarching theme of Vietnamese cities in transition. Some of this research deals with urban dynamics, some with the issues at stake within such dynamics, or with the strategies of the most significant stakeholders in urban transition: civil society, donors within the framework of official aid for development, consultants and international consultancy firms. These projects were carried out between 2001 and 2004 as part of the Urban Research Programme for Development (PRUD), and mainly focus on Hanoi and Ho Chi Minh City, or both in the case of comparative studies.Is there such a thing as a Vietnamese model of an Asian city? It seems that urban transition in Vietnam is not taking place in as radical and abrupt a manner as in China. The country's capacity for absorbing external models, the quest for a third way between state intervention and economic liberalism, and the fact that the country's architectural heritage is taken into account in urban planning, are just some of the reasons for its particularity. The issues addressed in each chapter, as well as the proposals for further research suggested by the contributors, should act as a catalyst for urban research in Vietnam.
