De la biología aprendimos que de la interacción con su entorno las especies desarrollan patrones genéticos que les permiten adquirir las características adecuadas para la supervivencia en su hábitat, esto es, desarrollar los mecanismos idóneos para hacer frente a los cambios del medio ambiente (adaptación biológica), a través de una serie de fases y esquemas adaptativos que constituyen la esencia de la evolución de todas las especies. Ahora bien, en la vida jurídica negocial, el contrato es organismo central de la disciplina, dotado como está de una morfología y una fisiología diseñadas para una finalidad específica cual es la satisfacción de la expectativa de las partes. El contrato es un organismo que existe jurídicamente, y su existencia busca crear, modificar o extinguir una realidad de hecho y de derecho; sin embargo, como todo organismo, está sujeto a las contingencias y variaciones de su ambiente, por lo que necesita asimismo ajustarse a los cambios de la realidad en que se manifiestan sus efectos, adaptarse fisiológicamente al proceso evolutivo del entorno que lo rodea. En este sentido, cuando se busca que los efectos del contrato sean compatibles con esa realidad, procurando los mecanismos idóneos para hacer frente al cambio de la misma, se habla de revisión, modificación, renegociación, en fin, adaptación contractual.
