Comparative Perspectives On The Enforcement And Effectiveness Of Antidiscrimination Law written by Marie Mercat-Bruns and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-06-30 with Law categories.

This book focuses on anti-discrimination law in order to identify commonalities and best practices across nations. Almost every nation in the world embraces the principle of equality and non-discrimination, in theory if not in practice. As the authors' expert contributions establish, the sources of the principle vary considerably, from international treaties to religious law, traditions and more. There are many approaches to methods of enforcement and other variables, but the principle is nearly universal. What does a comparison of the laws and approaches across different lands reveal? Readers may explore the enforcement and effectiveness of anti-discrimination law from 25 nations, across six continents. Esteemed authors examine national, regional and international systems looking for common and best practices, identifying innovative approaches to long-standing problems. The many ways that anti-discrimination law is enforced are brought to light, from criminal or civil prosecution through to community resolution processes, amongst others. Through comparing the approaches of different lands, the authors consider which methods of enforcement are effective. These enriching national and international perspectives highlight the need for more creative, concrete and coordinated means of enforcement to ensure the effectiveness of anti-discrimination law, regardless of the legal tradition concerned, but in light of these traditions. Readers will find each nation remarkable, and learn something new and interesting from each report.

Ownership Of The Human Body written by H.A. Ten Have and has been published by Springer Science & Business Media this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-11-11 with Medical categories.

This is the first book in healthcare ethics addressing the moral issues regarding ownership of the human body. Modern medicine increasingly transforms the body and makes use of body parts for diagnostic, therapeutic and preventive purposes. The book analyzes the concept of body ownership. It also reviews the ownership issues arising in clinical care (for example, donation policies, autopsy) and biomedical research. Societies and legal systems also have to deal with issues of body ownership. A comparison is made between specific legal arrangements in The Netherlands and France, as examples of legal approaches. In the final section of the book, different theoretical perspectives on the human body are analyzed: libertarian, personalist, deontological and utilitarian theories of body ownership.

Law and Mental Health: International Perspectives, Volume 3 considers the jurisprudence and models of legislation concerning public mental health that suit the particular requirements of different cultural and geographical regions. This book is composed of five chapters and begins with the major accomplishment both for Dutch legal psychiatry and for the English language audience, followed by a survey of the civil dimensions of the forensic system. The next chapter tackles the primary variables in assessing terrorism, including the social, political, religious, and economic factors, which, coupled with highly complex variables of psychological predisposition, can give some guarded inroads with respect to the limits of the knowledge in predicting and reacting to terrorist incidents. These topics are followed by discussions on the techniques for assessment designed for the differentiated legal questions in criminal, civil, and juvenile and family law. A chapter focuses on the measured assessments of the parameters of the professional knowledge about the nature of dangerous behavior based on clinical and research investigation. The final chapter contains a precise summary of the research that is to be done on a spectrum of techniques for assessing malingering. Mental health workers, forensic experts, and policy makers will find this book invaluable.

The Western Codification Of Criminal Law written by Aniceto Masferrer and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-03-09 with Law categories.

This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.

Sexual And Gender Diversity In The Muslim World written by Vanja Hamzic and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-11-23 with Social Science categories.

Discrimination on the grounds of sexual orientation or gender identity is forbidden in contemporary international human rights law, yet in many interpretations of Islamic law, this is seen to contradict the tenets of Islam. Vanja Hamzic here offers a path-breaking historical and anthropological analysis of the discourses on sexual and gender diversity in the Muslim world. The first of its kind, the book sheds new light on the understanding of diversity and resistance to hegemonic visions of the self in Muslim societies. Combining first-hand ethnographic accounts of Muslims in contemporary Pakistan including the hijra community whose pluralist sexual and gender experience defy the disciplinary gaze of both international and state law with new archival research, this book provides a unique mapping of Islamic jurisprudence, court practice and social developments in the Muslim world. Hamzic provides a comprehensive look at the ways in which sexually diverse and gender-variant Muslims are seen, and see themselves, within the context of the Islamic legal tradition.
