Western societies are witnessing an emerging socio-legal trend towards transnational civil litigation against multinational corporations in relation to harm caused toward people and the planet. These 'foreign direct liability cases' arise against the background of a global governance gap resulting from the rapid globalization of economic actors and activities with no global institutions to manage their worldwide impacts. The increasing reliance on private law mechanisms to realize corporate accountability for violations of human rights, health and safety, and environmental and labor norms perpetrated around the globe raises interesting and complex issues. This study sets out the legal and socio-political framework of this particular type of transnational civil litigation. The book traces the role that Western systems of tort law may play in promoting international corporate social responsibility/accountability. It focuses on the feasibility of bringing foreign direct liability claims before domestic courts in the EU Member States - the Netherlands in particular - and sets out a number of recommendations for European policymakers.

Organized crime, terrorism and hybrid forms of both are internationalized problems, affecting Germany as much as China. It is important to find solutions working for both sides without compromising social and political values. Since both countries differ in their normative preconditions and institutional setup, such a common response is difficult to reach. Differences in material criminal law as well as in criminal procedure law are obvious. Further frictions arise from constitutional and institutional aspects. Still, the authors engage in a common analysis of related phenomena and do not refrain from criticizing deficiencies in existing normative and institutional structures. This enables the reader to realize differences and to learn about possibilities for common action.

This book examines the paradox of collective identity in eastern Germany in the wake of German reunification. Following the fall of the Berlin Wall, citizens of the former German Democratic Republic were confronted with a dilemma: Were they already Germans without qualification, like their compatriots in the West? Or did they remain "East Germans" for the time being, with an identity tied to their distinct past, as if they were foreigners who had migrated without leaving home? How Memory Divides shows that these questions remain unresolved even today, less because of any "incomplete unity" between Germans in West and East, than because of the contradictory ways in which "easterners" themselves have remembered their past. Drawing on a unique study spanning two decades, the author reveals how divergent biographical memories have given rise to life stories with a diverse array of genres and storylines at odds with official accounts of the GDR and its demise. Over time, efforts to effect unity between West and East have reproduced divisions within the East.
