Menschenrechte und das humanit re Volkerrecht sind auf das gemeinsame geistige und moralethische Fundament zur ckzuf hren. Dennoch war ein Zusammenspiel lange Zeit nicht m glich und auch von Seiten der Vereinten Nationen und des Internationalen Komitees des Roten Kreuzes gar nicht erw nscht. Diese Abhandlung kl rt in einem ersten Schritt die Urspr nge und Entwicklung der beiden Rechtsgebiete, erkl rt hiermit die Gr nde f r das anf nglich fehlende Zusammenspiel und zeigt dann auf, wie es - fast zwangsl ufig - zu einer berschneidung des humanit ren V lkerrechts und der Menschenrechte kam (Kapitel B). Dann werden die grunds tzliche Unterschiede und berschneidungen herausgearbeitet (Kapitel C und D). Ein Vergleich der jeweiligen Anwendungsbereiche macht deutlich, dass noch L cken in der theoretischen (Kapitel E) und praktischen (Kapitel F) Anwendbarkeit bei den beiden Rechtsgebieten gibt. Zuletzt (Kapitel G) wird kurz auf das V lkerstrafrecht eingegangen, in dem sich die beiden Rechtsgebiete nun so nahe gekommen sind, dass sie einige der L cken bereits gef llt haben.

International courts and other actors are increasingly taking into account pre-existing social structures and inequalities when addressing and redressing human rights violations, in particular discrimination against specific groups. To date, however, academic legal research has paid little attention to this gentle turn in international human rights law and practice to address structural discrimination. In order to address this gap, this study analyses whether and to what extent international and regional human rights frameworks foresee positive obligations for State parties to address structural discrimination, and, more precisely, gender hierarchies and stereotypes as root causes of gender-based violence. In order to answer this question, the book analyses whether or not international human rights law requires pursuing a root-cause-sensitive and transformative approach to structural discrimination against women in general and to the prevention, protection and reparation of violence against women in particular; to what extent international courts and (quasi)judicial bodies address State responsibility for the systemic occurrence of violence against women and its underlying root causes; whether or not international courts and monitoring bodies have suitable tools for addressing structural discrimination within the society of a contracting party; and the limits to a transformative approach.

The book analyses the position of the ECtHR which has been more and more confronted with criticism coming from the national sphere, including the judiciary. This culminated in constitutional court judgments declaring a particular ECtHR judgment non-executable, for reasons of constitutional law. Existing scholarship does not differentiate enough between cases of mere political unwillingness to execute an ECtHR judgment and cases where execution is blocked for legal reasons (mainly of constitutional law nature). At the same time, the discussion under EU law on national/constitutional identity limiting the reach of the former has been only loosely linked with the ECHR context. This book presents a new dogmatic concept - 'principled resistance' - to analyse such cases. Taking up examples from the national level, it strives to find out whether the legal reasoning behind 'principled resistance' shows enough commonalities in order to qualify such incidents as expression of a 'new paradigm'.

The concept of obligations erga omnes - obligations to the international community as a whole - has fascinated international lawyers for decades, yet its precise implications remain unclear. This book assesses how this concept affects the enforcement of international law. It shows that all States are entitled to invoke obligations erga omnes in proceedings before the International Court of Justice, and to take countermeasures in response to serious erga omnes breaches. In addition, it suggests ways of identifying obligations that qualify as erga omnes.
