The Politics Of Climate Change And Uncertainty In India written by Lyla Mehta and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-12-24 with Nature categories.

This book brings together diverse perspectives concerning uncertainty and climate change in India. Uncertainty is a key factor shaping climate and environmental policy at international, national and local levels. Climate change and events such as cyclones, floods, droughts and changing rainfall patterns create uncertainties that planners, resource managers and local populations are regularly confronted with. In this context, uncertainty has emerged as a "wicked problem" for scientists and policymakers, resulting in highly debated and disputed decision-making. The book focuses on India, one of the most climatically vulnerable countries in the world, where there are stark socio-economic inequalities in addition to diverse geographic and climatic settings. Based on empirical research, it covers case studies from coastal Mumbai to dryland Kutch and the Sundarbans delta in West Bengal. These localities offer ecological contrasts, rural–urban diversity, varied exposure to different climate events, and diverse state and official responses. The book unpacks the diverse discourses, practices and politics of uncertainty and demonstrates profound differences through which the "above", "middle" and "below" understand and experience climate change and uncertainty. It also makes a case for bringing together diverse knowledges and approaches to understand and embrace climate-related uncertainties in order to facilitate transformative change. Appealing to a broad professional and student audience, the book draws on wide-ranging theoretical and conceptual approaches from climate science, historical analysis, science, technology and society studies, development studies and environmental studies. By looking at the intersection between local and diverse understandings of climate change and uncertainty with politics, culture, history and ecology, the book argues for plural and socially just ways to tackle climate change in India and beyond. The Common Law And English Jurisprudence 1760 1850 written by Michael Lobban and has been published by OUP Oxford this book supported file pdf, txt, epub, kindle and other format this book has been release on 1991 with History categories.

In this book, Michael Lobban argues that a proper understanding of English law and jurisprudence in the period is needed to clarify the nature of common-law practice and the way in which it was envisaged by its practitioners. He questions some commonly-accepted views of the nature of thecommon law itself and argues that attempts - notably those by Blackstone and Bentham - to expound or to criticize common law in essentially theoretical terms were mistaken. His approach is not a philosophically-based one, but he is concerned with the evolution and spread of judicial ideas which weregrounded upon the work of moral and political philosophers, and makes a valuable corrective contribution to our historical understanding of a critically important period in legal history.

The Nature And Authority Of Precedent

The Nature And Authority Of Precedent written by Neil Duxbury and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2008 with Judicial process categories.

Neil Duxbury examines how precedents constrain legal decision-makers and how legal decision-makers relax and avoid those constraints. There is no single principle or theory which explains the authority of precedent but rather a number of arguments which raise rebuttable presumptions in favour of precedent-following. This book examines the force and the limitations of these arguments and shows that although the principal requirement of the doctrine of precedent is that courts respect earlier judicial decisions on materially identical facts, the doctrine also requires courts to depart from such decisions when following them would perpetuate legal error or injustice. Not only do judicial precedents not 'bind' judges in the classical-positivist sense, but, were they to do so, they would be ill suited to common-law decision-making. Combining historical inquiry and philosophical analysis, this book will assist anyone seeking to understand how precedent operates as a common-law doctrine.
