How free is the speech of someone who can't be heard? Not very--and this, Owen Fiss suggests, is where the First Amendment comes in. In this book, a marvel of conciseness and eloquence, Fiss reframes the debate over free speech to reflect the First Amendment's role in ensuring public debate that is, in Justice William Brennan's words, truly uninhibited, robust, and wide-open. Hate speech, pornography, campaign spending, funding for the arts: the heated, often overheated, struggle over these issues generally pits liberty, as embodied in the First Amendment, against equality, as in the Fourteenth. Fiss presents a democratic view of the First Amendment that transcends this opposition. If equal participation is a precondition of free and open public debate, then the First Amendment encompasses the values of both equality and liberty. By examining the silencing effects of speech--its power to overwhelm and intimidate the underfunded, underrepresented, or disadvantaged voice--Fiss shows how restrictions on political expenditures, hate speech, and pornography can be defended in terms of the First Amendment, not despite it. Similarly, when the state requires the media to air voices of opposition, or funds art that presents controversial or challenging points of view, it is doing its constitutional part to protect democratic self-rule from the aggregations of private power that threaten it. Where most liberal accounts cast the state as the enemy of freedom and the First Amendment as a restraint, this one reminds us that the state can also be the friend of freedom, protecting and fostering speech that might otherwise die unheard, depriving our democracy of the full range and richness of its expression.

The events of September 11, 2001, combined with a pattern of increased crime and violence in the 1980s and mid-1990s in the Americas, has crystallized the need to reform government policies and police procedures to combat these threats. Public Security and Police Reform in the Americas examines the problems of security and how they are addressed in Latin America and the United States. Bailey and Dammert detail the wide variation in police tactics and efforts by individual nations to assess their effectiveness and ethical accountability. Policies on this issue can take the form of authoritarianism, which threatens the democratic process itself, or can, instead, work to "demilitarize" the police force. Bailey and Dammert argue that although attempts to apply generic models such as the successful "zero tolerance" created in the United States to the emerging democracies of Latin America—where institutional and economic instabilities exist—may be inappropriate, it is both possible and profitable to consider these issues from a common framework across national boundaries. This volume presents both an analysis of how identities are built, represented and negotiated in narrative, as well as a theoretical reflection on the links between narrative discourse and identity construction. The data for the book are Mexican immigrants' personal experience narratives and chronicles of their border crossings into the United States. Embracing a view of identity as a construct firmly grounded in discourse and interaction, the author examines and illustrates the multiple threads that connect the local expression and negotiation of identity to the wider social contexts that frame the experience of migration, from material conditions of life in the United States to mainstream discourses about race and color. "Alsop and Heinsohn present an analytic framework that can be used to measure and monitor empowerment processes and outcomes. The measuring empowerment framework, rooted in both conceptual discourse and measurement practice, illustrates how to gather data on empowerment and structure its analysis. The framework can be used to measure empowerment at both the intervention level and the country level, as a part of poverty or governance monitoring. The authors first provide a definition of empowerment and then explain how the concept can be reduced to measurable components. Empowerment is defined as a person's capacity to make effective choices--that is, the capacity to transform choices into desired actions and outcomes. The extent or degree to which a person is empowered is influenced by personal agency (the capacity to make purposive choice) and opportunity structure (the institutional context in which choice is made). Asset endowments are used as indicators of agency. These assets may be psychological, informational, organizational, material, social, financial, or human. Opportunity structure is measured by the presence and operation of formal and informal institutions, including the laws, regulatory frameworks, and norms governing behavior. Degrees of empowerment are measured by the existence of choice, the use of choice, and the achievement of choice. Following the conceptual discussion and the presentation of the analytic framework, the authors show how the measuring empowerment framework can be applied using examples from four development interventions. Each example discusses how the framework guided analysis and development of empowerment indicators. They also present a draft module for measuring empowerment at the country level. The module can be used alone or be integrated into country-level poverty or governance monitoring systems that seek to add an empowerment dimension to their analysis. Michael Uzendoski's theoretically informed work analyzes value from the perspective of the Napo Runa people of the Amazonian Ecuador. Based upon historical and archival research, as well as the author's years of fieldwork in indigenous communities, The Napo Runa of Amazonian Ecuadorpresents theoretical issues of value, poetics, and kinship as linked to the author's intersubjective experiences in Napo Runa culture. Drawing on insights from the theory of gift and value, Uzendoski argues that Napo Runa culture personifies value by transforming things into people through a process of subordinating them to human relationships. While many traditional exchange models treat the production of things as inconsequential, the Napo Runa understand production to involve a relationship with natural beings (plants, animals, and spirits of the forest) that they believe share spiritual substance, or samai. Value is the outcome of a complicated poetics of transformation by which things and persons are woven into kinship forms that define daily social and ritual life.
