Die Gemeinschaft "Chemin Neuf" entstand 1973 in Lyon aus einem charismatischen Gebetskreis und zählt zu jenen Aufbruchphänomenen, die unter dem Begriff der geistlichen Gemeinschaften und Bewegungen (GGB) zusammengefasst werden. "Chemin Neuf" versteht sich selbst als eine charismatisch und ignatianisch geprägte katholische Gemeinschaft mit ökumenischer Berufung. Kirchenrechtlich ist "Chemin Neuf" seit 1984 als öffentlicher Verein verfasst; seit 1992 gibt es zudem ein klerikales Ordensinstitut. Neben ihrer Struktur werfen auch Glaubenspraxis, Lebensweise und Pastoral der Gemeinschaft eine Reihe von Fragen auf. Die vorliegende Arbeit beleuchtet daher nicht nur Entstehung und Entwicklung von "Chemin Neuf", sondern geht ausdrücklich auch den Herausforderungen nach, die sich aus Verfassung, Selbstverständnis und Zugehörigkeitsformen von "Chemin Neuf" für Kirche und Kirchenrecht ergeben.

Nach dem Gesetzbuch der katholischen Kirche ist die Ehe nicht nur auf Nachkommenschaft hingeordnet, sondern auch auf das bonum coniugum, das Wohl der Gatten: Damit ist die erneuerte Ehelehre des II. Vatikanischen Konzils rechtlich umgesetzt; der personalen Dimension der Paarbeziehung wird eine wesentliche und eigenständige Rolle zugewiesen. In Ehenichtigkeitsverfahren spielt der Ausschluss dieser Hinordnung auf das Gattenwohl bislang jedoch kaum eine Rolle. Das Gattenwohl gilt vielen Gerichten als schwer fassbare und daher kaum justiziable Größe. Die vorliegende Studie zeigt auf, wie der Begriff des bonum coniugum inhaltlich gefüllt werden kann. Auf der Grundlage der bisherigen Rechtsprechung kirchlicher Gerichte und anhand von Überlegungen zur Partnergewalt, zur Gestaltung der ehelichen Sexualität und zur partnerschaftlichen Ko-Evolution werden verschiedene Varianten dieses Ehenichtigkeitsgrundes vorgestellt und Anknüpfungspunkte für die Praxis markiert.

Gnosticism is a countercultural spirituality that forever changed the practice of Christianity. Before it emerged in the second century, passage to the afterlife required obedience to God and king. Gnosticism proposed that human beings were manifestations of the divine, unsettling the hierarchical foundations of the ancient world. The canonical collections took their starting point from the ‘sacred law’ (ius sacrum) characteristic of canon law, since its norms promote the sanctification of the individual persons. This principle was the basis for the compilation of the so-called Pre-Gratian canon law collections, too. In the recent research, there have arisen new stresses on the better understanding of how this textual development of canonical collections had happened prior the Decretum Gratiani. An original canonical textual witness testifies about the circumstances of its origin, and, indeed, about the physical effects on the text during daily usage. The endeavor to issue the complete canon law did not mean only the composition of the universal canonical norms, but also the gathering of the particular norms, inveterate customs, or theological statements that could set the contents of the ecclesiastical discipline in the proper light.
