O desenvolvimento da família acompanhou a evolução da humanidade. E nesse processo se estabeleceu o modelo de família patriarcal que perdurou por diversas sociedades, em tempo e espaços distintos, em boa parte da história. Marcada pela hierarquia, a qual a figura paterna, chefe da casa, se sobrepunha à mulher e aos filhos. O matrimônio era um dos principais objetivos das famílias patriarcais, pois asseguraria a continuação dos costumes, centrados na religião, e da propriedade privada. Com efeito, a família nasce para a garantia da propriedade privada e procriação. Assim, o presente trabalho tem como objetivo analisar como se deu a (des)construção da família tradicional a partir do código civil. Quando falamos em (des)construção, não queremos aludir que as famílias devam ser destruídas, ao contrário, pretendemos que ela continue sendo ampliada conceitualmente, rompendo com os limites postos historicamente, que restringia a família à relação entre pessoas de sexo distintos e casadas.
