Annotation. In 2000 and 2001, twelve northern states of the Federal Republic of Nigeria introduced Islamic criminal law as one of a number of measures aiming at "reintroducing the shari'a." Immediately after its adoption, defendants were sentenced to death by stoning or to amputation of the hand. Apart from a few well publicised trials, however, the number and nature of cases tried under Islamic criminal law are little known. Based on a sample of trials, the present thesis discusses the introduction of Islamic criminal law and the evolution of judicial practice within the regions historical, cultural, political and religious context. The introduction of Islamic criminal law was initiated by politicians and supported by Muslim reform groups, but its potential effects were soon mitigated on higher judicial levels and aspects of the law were contained by local administrators. In the Western imagination, Islamic cultures are dominated by dogmatic religious norms that permit no nuance. Those fighting such stereotypes have countered with a portrait of Islam’s medieval “Golden Age,” marked by rationality, tolerance, and even proto-secularism. How can we understand Islamic history, culture, and thought beyond this dichotomy? In this magisterial cultural and intellectual history, Thomas Bauer reconsiders classical and modern Islam by tracing differing attitudes toward ambiguity. Over a span of many centuries, he explores the tension between one strand that aspires to annihilate all uncertainties and establish absolute, uncontestable truths and another, competing tendency that looks for ways to live with ambiguity and accept complexity. Bauer ranges across cultural and linguistic ambiguities, considering premodern Islamic textual and cultural forms from law to Quranic exegesis to literary genres alongside attitudes toward religious minorities and foreigners. He emphasizes the relative absence of conflict between religious and secular discourses in classical Islamic culture, which stands in striking contrast to both present-day fundamentalism and much of European history. Analysiert wird ebenfalls der Umgang der Theoretiker mit den religiosen Basistexten Koran und Prophetenaussagen. Neben den Fallbeispielen, in denen Gewalt legitimiert wird, widmet sich ein Kapitel auch der Rechtfertigung einer friedlichen Koexistenz von Muslimen und Nichtmuslimen ausserhalb islamischen Territoriums. Das Buch entstand im Rahmen des an den Universitaten Erfurt und Jena angesiedelten Forschungsverbundprojektes "Mobilisierung von Religion in Europa".
