La mayoría de los estudiosos de la pena de orientación liberal afirman actualmente que la protección de la sociedad constituye el fin de la misma. Este punto de vista, que puede ser considerado como producto de un cambio cultural general, no deja de ser en buena medida determinado por el crecimiento, en las últimas décadas, de los estudios psicológicos, psiquiátricos y sociológicos acerca del delincuente. Aquellos que sostienen este enfoque se inclinan a estimar la pena, y sobre todo el tratamiento penal, como algo que debe ser adoptado luego de un estudio no emocional y científico del problema; se piensa en medios gracias a los cuales la defensa social puede ser llevada a cabo: investigación de las causas del delito que posibilite una eliminación efectiva de los factores criminógenos, la rehabilitación o segregación —quizás, inclusive el exterminio— de los delincuentes sobre la base de considerar científicamente las posibilidades de reincorporarlos a la vida social como miembros útiles de la comunidad. El resultado —la defensa social— es percibido como fin, diferente en su esencia a la venganza y a la retribución, entendidas ambas como características de la pena en el pasado y sobrevivientes en alguna medida en el derecho penal de nuestra época.
