Los trastornos mentales originan hasta un tercio del total de los contactos con los servicios de salud en los países desarrollados y no desarrollados. En total, al menos el 20% de la población, niños y adultos, presentan cada año síntomas susceptibles de ser diagnosticados como trastorno mental, y hasta un 2,8% sufre algún trastorno mental crónico y discapacitante. En esta publicación se ha tratado de desarrollar algunos aspectos fundamentales del modelo de atención a la salud mental del siglo XXI, modelos y enfoques que ya forman parte de las estrategias y las prácticas de muchos de los centros de la Orden de San Juan de Dios. Desde esa visión, se pretende plantear los conflictos éticos que aparecen de manera más frecuente en la práctica asistencial, centrándose en los colectivos más vulnerables, los enfermos graves con trastornos persistentes y los niños y adolescentes con problemas mentales. El enfoque biopsicosocial que se aborda ofrece la base para el trabajo interdisciplinar en la asistencia psiquiátrica, una característica que, con mayor o menor acierto en la práctica, constituye uno de los ejes fundamentales de los modelos asistenciales en el mundo, y desde luego, el de la psiquiatría basada en la comunidad. En esta publicación se ha querido añadir otro componente esencial para los centros de la Orden Hospitalaria: la espiritualidad de la persona con enfermedad mental.

La monografía que se presenta al lector es un completo estudio de la discapacidad por enfermedad mental tras la reforma operada por la Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad jurídica (LRLCYP). En la monografía la autora reflexiona sobre las tres piezas fundamentales que conforman el complejo sistema de apoyo de la persona con discapacidad por enfermedad mental: 1º) Con relación al sistema de protección jurídica, se analizan las deficiencias advertidas en el modelo español de protección previo a la gran reforma operada en el CC español por la LRLCYP, para confrontarlas con el nuevo sistema de discapacidad propuesto, en el marco de ejecución de las normas de la Convención Internacional sobre los Derechos de las Personas con Discapacidad. 2º) Con respecto al diagnóstico y tratamiento de la enfermedad mental, se hace hincapié en cómo la implantación de las nuevas tecnologías, en particular, del novedoso sistema de impulso cerebral profundo (DBS), implica un nuevo modelo de apoyo para la exteriorización y recuperación de la capacidad natural de la persona con discapacidad. En esta parte de la monografía se ha contado con la inestimable colaboración de centros hospitalarios como el Hospital del Mar que están utilizando esta técnica para el tratamiento de ciertos trastornos mentales. 3º) Finalmente, la última parte de la obra se aproxima a una realidad social: la ayuda espontánea a la persona con discapacidad por enfermedad mental prestada por amigos y familiares. Se estudian ampliamente las dos instituciones del Derecho Civil que representan la instrumentación jurídica de esta solidaridad espontánea: la gestión de negocios ajenos y la guarda de hecho, cuya regulación se ha visto reformada en el CC por la LRLCYP.
