A presente obra é resultado dos estudos de doutoramento desenvolvidos na Faculdade de Direito da Universidade de Coimbra, Portugal. Nessa linha, minha área de atuação profissional como Procuradora de uma universidade pública brasileira é motivo para uma tese sobre Direito de Patentes na Pesquisa Universitária. Um dos maiores desafios foi analisar uma matéria de Direito Privado, sob a perspectiva do Direito Público. Essencial, portanto, apresentar os fundamentos da estrutura do sistema internacional de propriedade intelectual como um sistema aberto que se auto-organiza e se ajusta a diferentes regimes jurídicos nacionais e economias extremamente desproporcionais, o que demonstra sua capacidade de organização, retroalimentação, adequação, (re)organização e (re)adequação, de modo a adequar-se constantemente para cumprir sua finalidade, de coordenar o mercado internacional. Nesse contexto, as universidades tornaram-se titulares das invenções criadas por seus pesquisadores e as instituições encarregam-se da gestão administrativa, jurídica e econômica desses bens. Referimo-nos, assim, ao direito à patente, ao direito a ter direitos, nomeadamente o direito de patente, no âmbito do Direito Industrial – aqui referenciando o Professor Doutor João Paulo Fernandes Remédio Marques, que conduziu a orientação deste estudo, a quem dedico minha eterna gratidão.
