Norms beyond Empire seeks to rethink the relationship between law and empire by emphasizing the role of local normative production. While European imperialism is often viewed as being able to shape colonial law and government to its image, this volume argues that early modern empires could never monolithically control how these processes unfolded. Examining the Iberian empires in Asia, it seeks to look at norms as a means of escaping the often too narrow concept of law and look beyond empire to highlight the ways in which law-making and local normativities frequently acted beyond colonial rule. The ten chapters explore normative production from this perspective by focusing on case studies from China, India, Japan, and the Philippines. Vive-se em um mundo globalizado, transnacional, plural, onde tudo se interconecta e cada vez é mais difícil lidar e resolver os conflitos jurídicos, pois não há um poder soberano que cria um ordenamento jurídico que se aplica por coerção a todos. Assim, o Direito nacional não comporta questões transnacionais e o Direito internacional depende de acordos entre Estados que não são suficientes nem possuem a capacidade adequada para regular todas as questões transnacionais. Nesse cenário, defende-se a racionalidade jurídica romana republicana como critério de análise e resolução de conflitos transnacionais, tendo em vista que ela não se baseia em normas externas, mas na justiça do caso concreto, na naturalis ratio; é uma racionalidade perene, utilizada diversas vezes para resolver conflitos jurídicos na história, permitindo conciliar diferentes ordenamentos jurídicos provenientes de diferentes povos. Concluiu-se, assim, que a racionalidade jurídica romana republicana deve ser retomada como forma de ver o Direito, de se estudar e analisar as questões jurídicas para além das leis. O trabalho não sugere uma repetição de um sistema jurídico do passado, mas uma retomada na forma de se pensar e analisar o fenômeno jurídico por meio de uma racionalidade jurídica desvinculada de normas estatais.

A ideia de que o direito é mais do que a lei do Estado tornou-se consensual. Ela corresponde a uma das caraterísticas mais importantes da cultura política das últimas décadas. Este novo conceito - dito "pluralista" - do direito põe em causa a grande teoria do direito, estabelecida nos sécs. XIX e XX na base de um direito "estadual", abalando decisivamente as construções dogmáticas estabelecidas em teorias particulares das fontes de direito, da interpretação e da integração, da constituição. Mas o "pluralismo" coloca também problemas políticos centrais, pois ele conduz a um novo arranjo de distribuição do poder social de "dizer o direito" (do poder "jurisdicional").
