Excerpt from A Digest of English Civil Law, Vol. 3: Sections XII-XVII, Law of Property (Concluded) Is it presumptuous to say that the English Law of Trusts has satisfied the practical needs of the community? We think not, if the words be weighed. The complaint about Trusts has been, not that the rules are bad, but that trustees have been dishonest, or stupid, or both. Now that the great experiment of the Public Trustee has been undertaken to meet that difficulty, and has, apparently. Excerpt from A Digest of English Civil Law, Vol. 3: Sections III-XII, Law of Property (Continued) There seems to be nothing very special to remark upon in the contents of this volume; except, perhaps, the extra ordinary disproportion in bulk between the Law of Real Property and the Law of Chattels Corporeal. Whilst the former occupies, approximately, 500 paragraphs, the latter is stated in less than 70. It is well-known, of course, that much of the law affecting chattels is regarded by English jurists as belonging to the domains of Contract and Tort, previously explored; and it is not always so fully recog nized, that some parts of the Law of Real Property, e. G. Those dealing with Powers of Appointment and Mortgages, have been appropriated by the Law of Chattels. Still, the difference in bulk, after all allowances, is Striking; and, in the opinion of the writer, it is not entirely due to historical accident. Excerpt from A Digest of English Civil Law, 1912, Vol. 3: Sections I (Continued) An II; Law of Property (Continued) The origin of the distinction is suggestive to the student of legal history. It is, apparently, to be found in the fact that, in the process of legal development, certain Offences against proprietary interests are, for purely practical reasons, recognized as grounds Of action, long before any general theory Of proprietary rights is formulated. Consequently, such injuries acquire a special place in the scheme of law; and, with the inevitable conservatism of legal institutions, continue to be regarded from the negative standpoint of liabilities, rather than from the corresponding standpoint of rights. Thus, Blackstone, and other early institutional writers, were justified historically, though not logically, in. Excerpt from A Digest of English Civil Law, Vol. 3: Book II, Law of Quasi-Contract and Tort T was originally intended that the whole of the Law of Torts (as well as that of Quasi-contract) Should be included in this volume. But, as the work of preparing the volume proceeded, it became clear that this purpose could only be achieved at the cost of considerable delay, and with the result of making the volume unusually large. The pages which follow contain therefore only, of the Law of Tort, the General Part and the particular torts relating directly to property. Torts in respect of the person, the reputation, domestic and contractual relations, e. G. Assault, libel, slander, false imprisonment, malicious prosecution, etc., are left for the succeeding volume; which will, it is hoped, appear in the spring of next year. Excerpt from A Digest of English Civil Law, Vol. 1: General The German edition of the work has for some time been in course of preparation; and the first instalment of it, with a learned commentary by Dr. Gustav Schirrmeister, was published in the autumn of last year.* But it has occurred to the Editor and his colleagues, that an edition compiled especially with a view to English and American readers may be of value, not only to lawyers, but to officials and others engaged in the administration or study of English Law. With this idea, the present edition has been under taken; and the first instalment is now given to the public. Future instalments will, it is hoped, appear at reasonably short intervals. In particular, the Part dealing with the General Law of Contract may be expected before the end of the present year; while much of the later matter has already been composed, and only awaits revision.
