Excerpt from Titles to Real Estate in the State of New York: A Digested Treatise and Compendium of Law, Applicable to Titles to Real Estate in the State of New York This volume is an amplification of one of a similar but informal character, printed a few years since, and which, at the request of the publishers, and upon the suggestion of many members of the profession, reappears in its present form. The present edition includes many subjects of importance connected with realty not previously considered, and is otherwise much extended. The aim in compiling this treatise, has been the exposition of the principal features of the real estate law of this State in a practical shape, under clearly distinguishing heads, and within the compass of a single volume. Such a succinct treatment of the real estate system of this State - now grown to formidable proportions under the mass of statute law that has been appended to the revision of 1830 - will explain the somewhat terse style necessarily adopted in the reduction of the subject-matter into a comparatively small compass. Since the production of the valued Commentaries of Blackstone and Kent, and the disquisitions of the English common Jaw writers of the earlier portion of this century, the jurisprudence of this State has undergone great change and increase, imposing new labors on the profession. Real estate law, particularly, under the effect of legislation breaking away further and further from the common law system, and abolishing or modifying ancient principles under modern requirement, has grown into a system requiring not only study as such, but direction and guidance in its minute and special changes and provisions. Excerpt from The Law of Torts: A Treatise on the English Law of Liability for Civil Injuries For the present edition this work has been revised throughout, and I have made such additions and alterations as further consideration and the judicial decisions of the last three years have shown to be necessary. The most important of these additions and alterations are the following. The law of co-owners is now dealt with for the first time, both in respect of their rights of action against strangers (§ 25A) and in respect of their rights and remedies inter se (pp. 169 and 323). The question as to the possibility of successive actions for the same tort when that tort is actionable only on proof of actual damage is discussed in a somewhat lengthy note (p. 120). Similar treatment has been given to the difficult question as to the incidence of liability for the wrongful withdrawal of support to land in cases where the ownership or occupation of the supporting land has changed before the resulting subsidence takes place (p. 250). I have partially rewritten the section dealing with the rule laid down in Earl v. Lubbock, as to the liability of him who in breach of his contract with one person delivers a dangerous chattel which does harm to another person (pp. 373-378). The decision of the Court of Appeal in the unsatisfactory case of Baker v. Snell has given occasion for a more thorough consideration of the rule of absolute liability for mischief done by animals (§ 126A). In view of recent decisions such as Hunt v. The Star Newspaper Company I have also dealt more fully with the difficulties of the law as to fair comment (§ 144) These and other changes have necessitated a slight increase in the size of the book, but I have purposely preserved its original character as a compendium of legal principles rather than a digest of judicial decisions.
