A pesquisa teve como objetivo analisar a efetividade do direito à saúde por meio de políticas públicas mediante o comportamento omisso ou ativo, atribuídos ao Estado. Foram feitas algumas considerações com vistas a prevenir a violação da dignidade humana das mulheres presas, com recorte empírico no presídio Santa Luzia, em Alagoas. A metodologia utilizada se deu através de uma profunda análise literária e de documentos pertinentes, a partir de uma abordagem hipotético-dedutiva e dialética, com base na análise de instrumentos e regulamentos nacionais e internacionais de Direitos Humanos. Demonstrou-se que as mulheres encarceradas possuem demandas e necessidades de tratamentos específicos e carecem de políticas públicas; que reconhecem o problema, quase sempre agravado por um histórico de cometimento de constante violência institucional praticada nos presídios. Analisou-se o controle judicial do direito à saúde através das várias políticas públicas que asseguram o tratamento humanitário dos presos e, em especial, das mulheres em condição de vulnerabilidade, garantindo assim uma vida digna por meio de ações e serviços públicos específicos. Por fim, foi reconhecido que no presídio feminino Santa Luzia, em Alagoas, busca-se a melhoria das políticas públicas, principalmente de saúde, sob as orientações do Plano Estadual de Proteção à Mulher Privada de Liberdade e Egressa do Sistema Prisional.
