A última e mais recente Reforma da Previdência ocorreu por meio da promulgação, pelo Congresso Nacional, da Emenda Constitucional no 103, de 2019, que alterou a configuração da Previdência Social nos âmbitos administrativo, gerencial, financeiro, de arrecadação e de despesas, entre outros. Uma vez que a proteção social requer uma ação eficaz do Estado que respeite a proteção a uma vida digna, sem a extinção de direitos basilares, o presente estudo buscou analisar se os limites constitucionais principiológicos, referentes aos direitos e garantias fundamentais ‒ a dignidade da pessoa humana, o direito ao mínimo existencial, a vedação ao retrocesso social, a solidariedade e a isonomia ‒, foram observados nas alterações trazidas ao cálculo do benefício de pensão por morte no Regime Geral de Previdência Social (RGPS), por ter resultado numa redução considerável nos valores das pensões. Inicialmente, foram apontadas as nuances do direito fundamental à previdência social, com a dissecção da evolução histórica, seu âmbito de proteção e suas dimensões. No segundo momento, analisaram-se as reformas ocorridas no sistema previdenciário brasileiro desde o advento da Constituição de 1988, em especial a EC no 103/2019 no que se refere às disposições do benefício de pensão por morte. Por fim, traçou-se um panorama dos princípios fundamentais possivelmente feridos, a fim de avaliar a constitucionalidade da modificação conduzida no cálculo do benefício de pensão por morte no âmbito do RGPS.

Drawing on domestic and international law, as well as on judgments given by courts and human rights treaty bodies, Gender Stereotyping offers perspectives on ways gender stereotypes might be eliminated through the transnational legal process in order to ensure women's equality and the full exercise of their human rights. A leading international framework for debates on the subject of stereotypes, the Convention on the Elimination of All Forms of Discrimination against Women, was adopted in 1979 by the UN General Assembly and defines what constitutes discrimination against women. It also establishes an agenda to eliminate discrimination in all its forms in order to ensure substantive equality for women. Applying the Convention as the primary framework for analysis, this book provides essential strategies for eradicating gender stereotyping. Its proposed methodology requires naming operative gender stereotypes, identifying how they violate the human rights of women, and articulating states' obligations to eliminate and remedy these violations. According to Rebecca J. Cook and Simone Cusack, in order to abolish all forms of discrimination against women, priority needs to be given to the elimination of gender stereotypes. While stereotypes affect both men and women, they can have particularly egregious effects on women, often devaluing them and assigning them to subservient roles in society. As the legal perspectives offered in Gender Stereotyping demonstrate, treating women according to restrictive generalizations instead of their individual needs, abilities, and circumstances denies women their human rights and fundamental freedoms.

A obra demonstra a necessidade de avaliação sistemática das políticas previdenciárias da União, como fator de estabilidade social e segurança jurídica, com ênfase no estudo do regime de previdência complementar. Esse regime foi instituído como política de Estado para limitar os benefícios de aposentadoria e pensão por morte, pagos pelos regimes próprios de previdência social, ao teto de benefícios do RGPS, e, assim, reduzir o déficit da previdência social no serviço público. As sucessivas reformas constitucionais previdenciárias, introduzidas após a Constituição de 1988, visaram atenuar, de uma forma geral, as despesas crescentes da previdência social. Essas despesas afetam diretamente o orçamento e comprometem a ação governamental, em face do caráter constitucionalmente obrigatório de pagamento dos benefícios previdenciários. Por isso, a criação das entidades fechadas de previdência complementar, na União, teve como objetivo o equacionamento das contas do regime próprio de previdência social e, especialmente, a previsibilidade relativa ao limite do valor de pagamento dos benefícios de aposentadoria e de pensão por morte pagos pelo regime próprio da União. Nesse contexto, pensar a Previdência é se projetar no futuro e, com base na situação adiante vislumbrada, fazer o caminho inverso para começar a construi-la hoje, ponto no qual a avaliação e o necessário prazo de maturidade da política pública implementada refletem diretamente no resultado a ser alcançado.
