Justiça infame analisa representações das elites sobre o escravo na segunda metade do século XIX e a influência de fatores políticos sobre o Poder Judiciário imperial. Tem como pano de fundo o estudo de um crime ocorrido em 1876, em São Luís, Maranhão, atribuído à senhora Ana Rosa Viana Ribeiro, personagem abastada e casada com um político influente. O suposto assassinato de Inocêncio, criança escravizada de oito anos, levou à prisão e à acusação da senhora pelo Tribunal do Júri. Aquele foi um caso sem precedentes na história do Judiciário maranhense, pois desafiou os limites do poder senhorial sobre sua propriedade escrava, além de adquirir destacada repercussão na província e mesmo na Corte. Contribui, por isso mesmo, para o entendimento da Justiça e da política no Império a partir de uma localidade periférica. Distante do Centro-Sul do país, o Maranhão tensionou as regras projetadas para o Império, imprimiu traços peculiares à armação burocrática pensada para a nação e certamente inventou formas diversas de corrupção das instituições do século XIX.

A presente obra realizou o estudo de caso do debate legislativo em torno do Procedimento Abreviado pelo Acordo de Culpa – também conhecido como Acordo Penal. O intuito foi demonstrar se esse instituto jurídico, que comporia a justiça penal negociada no Brasil, seria a alternativa indicada para enfrentar o problema público do congestionamento do sistema de justiça criminal. A modalidade sugerida incluiria no ordenamento jurídico a possibilidade do réu, por meio do reconhecimento de culpa, abreviar o processo para imposição antecipada da sanção penal. A proposta legislativa foi apresentada mediante o Projeto de Lei no 882/2019, o qual ficou conhecido como Pacote de Lei Anticrime. A inclusão do artigo 395-A do Código de Processo Penal objetivava garantir a possibilidade de, após o recebimento da denúncia ou da queixa e até o início da instrução, o Ministério Público ou o querelante e o acusado, assistido por seu defensor, requerer, mediante acordo penal, a aplicação imediata das penas. Por fim, a obra mostra que o Acordo de Culpa se apresenta como um dos instrumentos de uma reforma capaz de minimizar problemas do Sistema de Justiça Criminal. Assim, o trabalho configura um estudo de análise de políticas públicas que consubstanciará a decisão política legislativa para a aprovação do Acordo de Culpa, com nova redação, no Novo Código de Processo Penal (em tramitação no Poder Legislativo).
