O presente estudo apresenta uma proposta exegética do direito positivo, utilizando o ferramental da semiótica. O capítulo inicial expõe a metodologia interpretativa, pautada na linguagem e no processo interpretativo da construção da norma jurídica, denominado percurso gerador de sentido. No segundo capítulo, expõe-se a estrutura da regra-matriz de incidência tributária, no intuito de realizar o recorte metodológico do critério material do ISS. No capítulo terceiro, é iniciada a incursão no sistema do direito positivo, em específico no altiplano constitucional, no intento de expor caminho interpretativo sistêmico do texto constitucional a fim de elucidar a função da lei complementar e a amplitude da norma de competência municipal, ao qual se refere a instituição do imposto sobre serviços. No capítulo quarto, é realizada análise do paradoxo da obrigação de fazer como pressuposto de incidência do ISS, munidos da definição como ferramenta interpretativa, a fim de elucidar os termos sustentados no âmbito da Ciência do Direito acerca da materialidade do ISS. No capítulo quinto, são analisados os casos da pragmática jurisprudencial e a superação da obrigação de fazer. No capítulo sexto, tem-se a junção de todos os capítulos anteriores, no intento de evidenciar uma proposta interpretativa do direito positivo e concluir que a locação é um serviço e passível de incidência do imposto sobre serviços.
