FRA’s second survey on LGBTI people in the EU, North Macedonia and Serbia surveyed almost 140,000 participants. This technical report presents a detailed overview of the survey methodology used by FRA when collecting the survey data. The EU LGBTI II survey is a large-scale web-administered survey of the experiences and views of lesbian, gay, bisexual, transgender and intersex (LGBTI) individuals, using an anonymous online questionnaire. The survey was conducted between 27 May and 22 July 2019 via the platform www.lgbtisurvey.eu and collected valid responses from 139 799 participants from the European Union (EU) Member States, North Macedonia and Serbia. The survey provides comparative evidence on how LGBTI people in the EU experience discrimination, violence and harassment in various areas of life, including employment, education, healthcare, housing and other services. The aims of the survey were (1) to obtain data that would allow a better understanding of how LGBTI people experience the enjoyment of fundamental rights and would provide policymakers and key stakeholders with research evidence that could be used to assess the implementation and impact of law and policy and to address gaps in the protection of rights; (2) to detect trends by identifying changes over time with respect to the results of the first LGBT survey (2012); (3) to further develop research methodologies for online survey tools; (4) to deliver to stakeholders, civil society and the wider public research evidence and data that could be valuable in raising awareness of fundamental rights and could contribute to promoting LGBTI equality and improving the situation on the ground.

This report presents select findings from FRA's 2019 survey on LGBTI people in the EU and North Macedonia and Serbia. With almost 140,000 participants, it is the largest survey of its kind. It follows the agency's first survey on LGBT people in the EU, conducted in 2012. The new survey results show little progress over the past seven years. Discrimination in everyday life persists - at work and at school; at cafés, restaurants, bars and nightclubs; when looking for housing; when accessing healthcare or social services; and in shops. Harassment and physical and sexual attacks also remain concerns. Trans and intersex people especially face challenges, including when having to show identification documents. For LGBTI people aged 15 to 17, the situation is mixed. While the young encounter more harassment than their older peers, they also see more individuals standing up for LGBTI people at school. The results also show that LGBTI people across the EU - and beyond - believe that law and policy, as well as behaviour by politicians, public figures, community leaders and civil society, greatly affect their lives. By presenting key findings from its second survey, FRA aims to encourage policy- and decision-makers to step up their efforts to promote full respect for the rights of LGBTI people.

The Covid-19 pandemic has revealed how far we as a European society still are from the proclaimed Union of Equality. The book explores how the promise of equal treatment can become a reality and compliance with the EU acquis relating to equality and non-discrimination can be improved. It studies enforcement and promotion aspects of the two watershed directives of 2000, the Racial Equality Directive 2000/43/EC and the Employment Equality Directive 2000/78/EC, through the lens of reflexive governance. This governance approach is proposed as having great potential in enhancing the likelihood of sustainability (or continuation) of reforms in the current candidate countries and EU Member States through its emphasis on reflexive learning processes and the cooperation between EU institutions, national authorities, and civil society actors. In order to deploy this potential, there is, however, a need for more consistent and transparent monitoring, both with regard to candidate countries as well as old and new Member States, and a reconsideration of the understanding of monitoring as such. It should be seen as helping to deconstruct own preference-formations and as a possibility to learn from successes and failures in a cooperative and recursive process. To work on these lacunae and improve learning and monitoring processes, this book identifies indicators, that are deduced from the comparative review of the implementation practice of the member states. This book is thus a contribution to the existing literature in the fields of Europeanization, governance, and the right to equality and non-discrimination.
