Por que o País se encontra tão combalido e impassível, sem capacidade de reagir ao atual cenário, pois, num processo de autofagia, observa gradativa ruína em diferentes cenários de crise? Em parte, talvez se explique essa impassibilidade a partir dos fatos que se sucederam após o desembarque de Tomé de Souza na Bahia, em março de 1549. Ele trazia consigo as disposições expressas sobre o Regimento do Governo e, entre outras iniciativas político-administrativas, preparou o terreno para pôr fim ao descentralismo senhorial das capitanias hereditárias, além de implantar a ordem jurídica portuguesa na Colônia. Diante de tal cenário, este volume discorre sobre os antecedentes à época do descobrimento, os períodos de Colônia, Império e República até a Revolução de 1930, sempre com o compromisso de abordar as sucessivas Constituições brasileiras da época (a do Império, de 1824; e da República, de 1891), a legislação federal de destaque, o quadro socioeconômico de forma contextual e dialética, ou seja, do Estado lusitano até a organização do Estado brasileiro segundo o período analisado neste volume, sendo enfocado, também, o direito português e seus reflexos no Brasil Colonial. Na sequência, analisa-se a questão constitucional durante o Império, a Constituição promulgada durante a República Velha e a ordem jurídica predominante.
