A obra que o leitor tem em mãos é fruto de pesquisa sobre a ação de dissolução parcial de sociedade personificada sob a ótica do Direito Processual Civil na perspectiva dos direitos fundamentais das partes que foi objeto de dissertação de mestrado da autora pela Pontifícia Universidade Católica do Rio Grande do Sul. Enfrenta-se a referida temática, abordando a evolução legislativa do fenômeno da dissolução parcial de sociedade personificada, contextualizada no plano do Direito Material e do Direito Processual. Trabalha-se com o quadro de direitos fundamentais relacionados à ação de dissolução parcial de sociedade personificada, como o direito fundamental à liberdade de contratar, notadamente quanto ao dito fenômeno às avessas (liberdade de distratar), juntamente dos direitos fundamentais processuais, como o direito à tutela jurisdicional adequada e efetiva, o direito ao contraditório, o direito à segurança jurídica no processo, especialmente do respeito à coisa julgada e seus devidos desmembramentos. O regramento da ação de dissolução parcial de sociedade personificada pelo Código de Processo Civil de 2015 está pautado no direito fundamental à liberdade de contratar e distratar, com vistas à adequação e à efetividade do processo. Analisa-se as hipóteses de se tratar com a ação de dissolução parcial de sociedade personificada a partir da aplicação das cláusulas de escalonamento processual. Defende-se a aplicação do tema na perspectiva do princípio da autonomia privada que rege os contratos societários, bem como na observância da autonomia da vontade das partes à resolução de seus conflitos.
