O presente trabalho pretende analisar o ordenamento jurídico brasileiro no que diz respeito ao instituto jurídico da guarda compartilhada, especificamente a partir de sua obrigatoriedade, e contrapô-la ao Princípio do Superior Interesse da Criança. Iniciamos o estudo analisando o poder familiar, reconhecendo que ele é oriundo da relação paterno- filial e é através desse poder que os pais são cobrados para estar mais próximo do cotidiano dos filhos, acompanhando o desenvolvimento integral deles. Como parte do poder familiar encontra-se a questão da guarda dos filhos menores. Dentre as modalidades de guarda, destacam-se: a unilateral, a compartilhada, a alternada e a atribuída a terceiros; entretanto preferimos abordar majoritariamente a guarda compartilhada porque ela permite uma convivência equilibrada entre os seus pais, mesmo que eles não vivam sob o mesmo teto. A Lei n.o 13.058/14 alterou o Código Civil e estabeleceu a obrigatoriedade da guarda compartilhada, mesmo não havendo acordo entre os pais. As exceções são quando eles não estejam aptos a exercer o poder familiar e quando um (ou os dois) declarar(em) perante o juiz o desinteresse na guarda do filho. A partir da análise da doutrina e jurisprudência, pretendemos responder à questão: a obrigatoriedade da guarda compartilhada fere o Princípio do Superior Interesse da Criança? Essa resposta deve levar em consideração a existência de litígios entre os pais após, o rompimento da relação conjugal, com as suas peculiaridades.
