In early-nineteenth-century America, and especially in the Old South, the use of oratory appealed to legal professionals--judges as well as advocates. Consistent with the humanism proclaimed in classical and neoclassical works, appellate judges perceived their civic duties to demand oratorical skill as well as legal expertise. In A Peculiar Humanism, William E. Wiethoff assesses the judicial use of oratory in reviewing slave cases and the struggle to fashion a humanist jurisprudence on slavery despite the customary restraints placed on judicial advocacy. Drawing attention to a neglected intersection of law and letters, Wiethoff analyzes the proslavery discourse embedded in antebellum judicial opinions by examining the public addresses, judicial narratives, and private papers of sixty-nine appellate judges. By contrasting the judges' proslavery appeals in a variety of cases in the upper and deep South, Wiethoff shows how context shaped the judges' perceptions, priorities, and arguments. Excerpt: ... would be absurd to assert that the products of logical analysis, the "a priori forms of intuition and thought," such as Space and Time, Cause, Substance, Interaction, etc., were actt1al existences, and not abstractions "implied in reality." And so Kantian epistemology remains in the air, a great mist, as it were, suspended between science and metaphysics, and makes ineffectual attempts to come into contact with both. But this is intrinsically impossible, and all it does is to obscure the issues between science and metaphysics, and by the fog it raises, to prevent the combatants from meeting, and either fighting out, or, as is more probable, composing their differences. Its contributions to the question of the relation of science and metaphysics are always irrelevant and often misleading. For whether it be its misfortune or its fault, epistemology is in the habit of using terms in a peculiar sense of its own. When we are told, e.g., that " the conception of cause is a priori and cannot be derived from experience, because it is the presupposition of all experience," or informed that "an eternal self is the presupposition of all knowledge," we are, according to the bent of our sympathies, either consoled or confounded. But the exultation of the one party and the depression of the other are alike premature. Upon further inquiry it appears that the priority of the epistemologists is not in time at all and does not refer to historical events. They are not making scientific statements about the actual origin or metaphysical statements about the ultimate nature of knowledge, but only speaking about the relation of certain factors in existing knowledge. Philosophers, both western and eastern, have long been divided between 'humanists', for whom 'man is the measure of things', and their opponents, who claim that there is a way, in principle knowable and describable, that the world anyway is, independent of human perspectives and interests. The early chapters of The Measure of Things chart the development of humanism from medieval times, through the Renaissance, Enlightenment and Romantic periods, to its most sophisticated, twentieth-century form, 'existential humanism'. Cooper does not identify this final position with that of any particular philosopher, though it is closely related to those of Heidegger, Merleau-Ponty and the later Wittgenstein. Among the earlier figures discussed are William of Ockham, Kant, Herder, Nietzsche and William James. Having rejected attempts by contemporary advocates of modest or non-metaphysical realism to dissolve the opposition between humanism and its 'absolutist' rival, Cooper moves on to an adjudication of that rivality. Prompted by the pervasive rhetoric of hubris that the rivals direct against one another, he argues, in an original manner, that the rival positions are indeed guilty of lack of humility. Absolutists - whether defenders of 'The Given' or scientific realists - exaggerate our capacity to ascend out of our 'engaged' perspectives to an objective account of the world. Humanists, conversely, exaggerate our capacity to live without a sense of our subjection to a measure independent of our own perspectives. The only escape, Cooper maintains, from the impasse reached when humanism and absolutism are both rejected, lies in a doctrine of mystery. There is a reality independent of 'the human contribution', but it is necessarily ineffable. Drawing in a novel way upon the Buddhist conception of 'emptiness' and Heidegger's later writings, the final chapters defend the notion of mystery, distinguish the doctrine advanced from that of transcendental idealism, and propose that it is only through appreciation of mystery that measure and warrant may be provided for our beliefs and conduct.

Martin Heidegger's impact on contemporary thought is important and controversial. However in France, the influence of this German philosopher is such that contemporary French thought cannot be properly understood without reference to Heidegger and his extraordinary influence. Tom Rockmore examines the reception of Heidegger's thought in France. He argues that in the period after the Second World War, due to the peculiar nature of the humanist French Philosophical tradition, Heidegger became the master thinker of French philosophy. Perhaps most importantly, he contends that this reception - first as philosophical anthropology and later as postmetaphysical humanism - is systematically mistaken.
