As a settler state, Canada’s claims to sovereign control over territory are contested by Indigenous claims to land and to self-determination. Indigenous Peoples and the Future of Federalism presents legal analyses that explore forms of federalism and their potential to include multiple and divided sovereignties. Canada was a small country in 1867, but within twenty years its claims to sovereignty spanned the continent. With Confederation came the vaunting ambition to create an empire from sea to sea. How did Canada lay claim to so much land so quickly? Land and the Liberal Project examines the tactics deployed by Canadian officialdom from the first articulation of expansionism in 1857 to the consolidation of authority following the 1885 North-West Resistance. Éléna Choquette contends that although the dominion purported to absorb Indigenous lands through constitutionalism, administration, and law, it often resorted to force in the face of Indigenous resistance. She investigates the liberal concept that underpinned land appropriation and legitimized violence: Indigenous territory and people were to be “improved,” the former by agrarian capitalism, the latter by enforced schooling. By rethinking this tainted approach to nation making, Choquette’s clear-eyed exposé of the Canadian expansionist project offers new ways to understand colonization.

This edited book explores diverse contestations and transformations of sovereignty around the world. Sovereignty plays a central role in modern political thought and practice, but it also remains fundamentally contested. Depending on the context and perspective, it seems either omnipresent or elusive, liberating or oppressive, fading or resilient. Indeed, if in recent decades sovereignty has been expected to wane, today it is back on the agenda; not as the solid bedrock of modern – international – politics, which it never was, but as variations on a concept and institution that are ever contested and, as a result, constantly transforming. Bringing together perspectives from various disciplines, including International Relations (IR), political theory, geography, law, and anthropology, this volume: • goes beyond debates over the resilience or decline of sovereignty to instead emphasize how precisely the inherent ambiguities, tensions, and contestations in scholarship and practice spark sovereignty’s manifold transformations; • offers three theoretical chapters that examine the illusions, contradictions, transformation, and lasting appeal of sovereignty and the nation-state; • explores sovereignty from various disciplinary perspectives in 11 empirical chapters that highlight its role in different contexts around the world, from the European Union (EU) to the South China Sea, to Western Sahara and Palestine; • problematizes the interplay between theory and practice of statehood and sovereignty, as in the perception of Northern Cyprus as a ‘fake state’, scholars’ promotion of Kurdish ‘statehood’ in Iraq, and studies affirming the ‘Islamic State’. For centuries, western political thought has addressed the problem of pluralism primarily through the prism of state sovereignty. Sovereignty and Contestation explores how contemporary pluralism is shaped by concepts of state sovereignty and how particular practices of pluralism are challenging sovereignty in turn. The book presents a unique comparison of Indigenous/Settler relations in Canada with Union/State relations in the European Union. By placing ndigenous peoples alongside European nations as equal agents in a transnational field of action, the book connects disparate literatures on sub-state and supra-state pluralism. Using an interdisciplinary and practice-centred approach, Keith Cherry explores how political, legal, and economic practices co-generate unique blends of sovereignty and pluralism in each setting, offering an account of pluralism that significantly expands on traditional political science accounts. Ultimately, the book identifies two sets of practices that have played key roles facilitating pluralism in both Canada and Europe – interpenetrating institutions and conditional authority claims. Cherry considers the conditions under which these practices are most likely to emerge and to flourish. He concludes that such practices are most successful where all parties can contest the terms and content of their relationships, and where all parties need one another. In doing so, Sovereignty and Contestation highlights how contestability and mutual need provide novel criteria through which practices of pluralism can be assessed and developed.
