The book uses critical sociolinguistic analysis to examine the social consequences of courtroom talk. The focus of the study is the cross-examination of three Australian Aboriginal boys who were prosecution witnesses in the case of six police officers charged with their abduction. The analysis reveals how the language mechanisms allowed by courtroom rules of evidence serve to legitimize neocolonial control over Indigenous people. In the propositions and assertions made in cross-examination, and their adoption by judicial decision-makers, the three boys were constructed not as victims of police abuse, but rather in terms of difference, deviance and delinquency. This identity work addresses fundamental issues concerning what it means to be an Aboriginal young person, as well as constraints about how to perform or live this identity, and the rights to which Aboriginal people can lay claim, while legitimizing police control over their freedom of movement. Understanding this courtroom talk requires analysis of the sociopolitical and historical actions and structures within which the courtroom hearing was embedded. Through this analysis, the interrelatedness of structure, agency, constraint and change, which is central to critical sociolinguistics, becomes apparent. In its investigation of language ideologies that underpin courtroom talk, as well as the details of how language is used, and the social consequences of this talk, the book highlights the need for far-reaching changes to courtroom rules of evidence.

Misunderstanding is a pervasive phenomenon in social life, sometimes with serious consequences for people's life chances. Misunderstandings are especially hazardous in high-stakes events such as job interviews or in the legal system. In unequal power encounters, unsuccessful communication is regularly attributed to the less powerful participant, especially when those participants are members of an ethnic minority group. But even when communicative events are not prestructured by participants' differential positions in social hierarchies, misunderstandings occur at different levels of interactional and social engagement. Misunderstanding in Social Life examines such problematic talk in ordinary conversation and different institutional settings, including socializing events and story tellings, education and assessment activities, and interviews in TV news broadcasts, employment agencies, legal settings, and language testing. The analyzed interactions are located in a variety of sociocultural environments and conducted in a range of languages, including English, French, German, Hebrew, Japanese, such language varieties as Aboriginal Australian English and Maori New Zealand English, and nonnative varieties. The original studies included in this volume adopt a variety of theoretical perspectives, including discourse-pragmatic approaches, conversation analysis, interactional sociolinguistics, social constructionism, tropological and narrative analysis. Aboriginal people are grossly over-represented before the courts and in our gaols. Despite numerous inquiries, State and Federal, and the considerable funds spent trying to understand this phenomenon, nothing has changed. Indigenous people continue to be apprehended, sentenced, incarcerated and die in gaols. One part of this depressing and seemingly inexorable process is the behaviour of police. Drawing on research from across Australia, Chris Cunneen focuses on how police and Aboriginal people interact in urban and rural environments. He explores police history and police culture, the nature of Aboriginal offending and the prevalence of over-policing, the use of police discretion, the particular circumstances of Aboriginal youth and Aboriginal women, the experience of community policing and the key police responses to Aboriginal issues. He traces the pressures on both sides of the equation brought by new political demands. Volume 19 of the Australian Dictionary of Biography (ADB) contains concise biographies of individuals who died between 1991 and 1995. HIV/AIDS child activists Tony Lovegrove and Eve Van Grafhorst have entries, as does conductor Stuart Challender, ‘the first Australian celebrity to go public’ about his HIV/AIDS condition in 1991.
