Professor Theo van Boven has made his mark in the field of human rights by writing a vast number of scholarly articles, reports, studies, congress papers and the like, covering many topics. Most of his work has been published in law journals, textbooks, Festschrifts and other sources. Since not all of these publications are easily accessible, it is the purpose of this anthology to bring together a selection of his writings from 1966 to 1998. The editors have focused on those subjects that played a major part during Theo van Boven's career and that are, in their view, the most interesting to the reader. That is why this volume contains papers on such issues as the United Nations and its role as regards human rights, racial discrimination, the right to rehabilitation, the international criminal tribunals, the role of NGOs and many more. The papers have been arranged in different groups under general headings. Within each group, articles dealing with the same subject have been put in chronological order. A detailed bibliography, covering most of Theo van Boven's publications, is included in this book as an annex. All through his work Theo van Boven displays his sound theoretical background as well as his enormous practical experience. This combination makes his writings so attractive and compelling to read.

This collection provides an overview of some of the most relevant concepts in the study of the language of inclusion and exclusion, specifically with a view to the functioning of nation-state categories. Categorizations, words, and phrases are constantly renewed with the intention to exclude (mostly) or to include (rarely), promulgating problematizations that highlight discursive distinctions between in-groups and out-groups. Such discursive constructions and the practices through which they are effectuated are sites of symbolic power, and their study reveals the workings of power. Historical analysis of the language of inclusion and exclusion can help elucidate contemporary transformations of discursive power. The chapters in this volume discuss forms of discursive problematization such as defining, claiming, legitimizing, expanding, sensationalization and suggestion, and it connects these to the discursive drawing of boundaries, focusing on discursive constructions of ‘illegality’, race, class, gender, immigrant integration and transnationalism. As state categorizations continuously differ, both the historical analysis of their genesis, functioning and transformation, and the contemporary analysis of their practical effectuation are crucial to an understanding of inclusion and exclusion. As societies become more diverse, so too must they become more inclusive. In inclusive societies, all members, regardless of their ethnicity, religion, socio-economic status, ability or disability are valued and free to participate, and there is equity of access and reward. Schools have a powerful role to play in creating inclusive societies, and this begins with the notion of inclusive schools - schools were all children belong, where all children have a place, and where difference is a natural part of what it is to be a human being. Based on this understanding, many countries around the world are moving towards more inclusive education systems. However, working against inclusive education are forces of exclusion – factors that act to exclude and marginalize minority students from participation and learning at school. Therefore, in order to progress the principles and practices of inclusive education, an examination of the construct of exclusion is critical. Important questions to be interrogated if inclusive education is to be a reality are: What is exclusion? Why does it occur? How can it be reduced and eliminated? This book critically examines the construct of exclusion, exploring how disabled students experience exclusion both from and within school and suggesting reasons why this occurs. Finally, key foci for change are proposed as platforms for interrogating, reducing and eliminating the forces of exclusion.
