Excerpt from A Treatise on American Citizenship This book was prepared at the solicitation of the publishers, but in obedience to a long-cherished wish to see the discussion of the origin, nature, and obligations of American citizenship, state and national, reduced to compendious form in one volume. The subject is not only one concerning which the legal profession should have a convenient text-book, but is an indispensable part of the education of every man who makes pretension to a fair education and knowledge of the history of his country. I have, I may say without vanity, had unusual need for the study of all these questions, for as I grew up they were the great points of difference between our people. As they were settled one by one, I studied the reason and argument of the decision, and later in life questions of citizenship and suffrage have been involved in many of the cases I have tried. It is not believed that this is a perfect book, nor is it doubted that in time it will be supplanted by another or others dealing more ably with the subjects discussed and grouping them more conveniently, but for the present, at least, it is hoped that it will supply, as no other text-book known to the author does, the basis for special lectures on this most important topic in our law schools, and a convenient key for references to the active members of our profession. Excerpt from A Treatise on the Law of Citizenship in the United States "The distinction between citizens proper, that is, the constituent members of the political sovereignty, and subjects of that sovereignty who are not, therefore, citizens is recognized in the best authorities of the public law." This distinction is true. The further question of who are and who are not citizens has its difficulties, Accept the definition of citizenship to be the enjoyment of equal rights and privileges at home, and equal protection abroad, and consider the question from this standpoint, from which alone it should be treated, for we have no law in the United States which divides our citizens into classes or makes any difference whatever between them. We then discover the importance that the equal rights of citizens when at home should maintain when abroad, because questions as to citizenship are determined by municipal law in subordination to the law of nations. Therefore, the value of citizenship should not be underestimated. Every individual should have some central point from which he emanates and to which he returns, where he is clothed with citizenship and the consequent enjoyment of all rights and privileges which citizenship confers. Excerpt from The Rights and Duties of American Citizenship The purpose of the present work is to present to American youths practical information as to the rights and duties which attach to American citizenship. In the effort to do this in the clearest and most logical form, the stereotyped method of giving a running commentary upon the Constitution has been discarded. Of all political forms, the federal type is the most complex; and it is, therefore, little short of absurd to attempt, as do so many text-books on Civics, to explain to students who are without previous training the constitutional relations of our elaborate system of national, state, and local governments, without first giving to them a knowledge of the nature of political authority, the purposes for which it exists, and the general governmental means through which such purposes are attained. Under these laws lax and unsatisfactory methods of naturalization had grown up, opening the way to gross frauds against our citizenship, including perjury, false impersonation, and traffic in false and counterfeit certificates of citizenship. Such certificates were sometimes sold to alien criminals to secure their ad mission to the United States, and frequently to procure protection against their home governments. Cases have actually occurred where aliens have landed on our shores for the first time, having in their possession certificates entitling them to the full rights of American citizenship.
