This dissertation is a critical examination and rejection of the two principal types of moral justification, the compensatory and noncompensatory, of affirmative action involving preferential treatment (AA) for blacks, Hispanics, American Indians, and women in hiring, promotions, andadmissions. Neither of these approaches to the justification of AA, I have argued, is able to defend AA successfully. AA not morally justified. Thus, succeeding compensatory arguments for AA, individualand group oriented, are unable to evade, undermine, or disarm the objections that AA violates the principles of compensatory justice governing who is owed compensation, what compensation is owed, and who owes compensation, and that AA violates the principles of justice and fundamental individual moral rights governing the distribution of such social goods or benefits as desirable and valuable positions. The principles of justice and moral rights violated by AA govern the distribution of social benefits, including desirable positions, and burdens and systematize, unify, and explain correct moral judgments about the injustice of actions, policies, and practices in a variety of contexts of distribution. Moreover, backward-looking or compensatory arguments for AA have the implication that unjust and morally unacceptable compensatory policies that are morally similar to AA would be justified in contexts other than hiring, promotions, and admissions. Furthermore, the noncompensatory justifications of AA, including meritocratic and utilitarian forward-looking arguments, are unable to evade or to undermine the objection that AA violates principles of justice and fundamental individual moral rights and the objection that these attempted justifications of AA have the implication that unjust and morally unacceptable noncompensatory, forward-looking policies that are morally similar to AA would also be justified in contexts other than the standard ones.

Affirmative action: does it really counteract racism? Is it morally justifiable? In her timely and tough-minded book, Gertrude Ezorsky addresses these central issues in the ongoing controversy surrounding affirmative action, and comes up with some convincing answers. Ezorsky begins by examining the effectiveness of affirmative action as a remedy for institutional racism in the workplace. She analyzes the ways in which common practices-selection of employees based on personal connections, qualification, and seniority standards-perpetuate the injurious effect of past racial discrimination, and she assesses the rationale for such affirmative action measures as objective job-related testing, numerical goals, and preferential treatment for basically qualified blacks. To illuminate the social reality in which affirmative action takes place, she draws on recent work by social scientists and legal scholars. Turning to the moral issues, Ezorsky posits two basic justifications for affirmative action: first, looking backward-to provide deserved compensation for past racial injustice that was sanctioned, practiced, and encouraged by our government; second, looking forward-to promote racial desegregation in the American workplace. Unlike some supporters of affirmative action, she does not deny that preferential treatment may place an unfair burden on white males. Indeed, she suggests specific practical measures for spreading that burden more equitably. "What makes affirmative action morally (un)justified? That is this book's core question. Its main contribution consists in a meticulous scrutiny of the strength of the six main arguments for-i.e., the compensation, the anti-discrimination, the equality of opportunity, the role model, the diversity, and the integration-based justifications-and the five main objections to affirmative action-i.e., the reverse discrimination, the stigma, the mismatch, the publicity, and the merit-based objections-and of how these arguments relate to one another. The book argues that all of the five main objections to affirmative action are either flawed or quite limited in terms of their implications. With regard to the arguments in favor of affirmative action, the book shows why the anti-discrimination and equality of opportunity-based arguments provide strong justifications for many affirmative action schemes. In light thereof and the fact that the five most influential arguments against affirmative action are all flawed or otherwise weak, the overall claim defended in the book is that many of the schemes that people have in mind when they discuss affirmative action (many of which are presently on the retreat) are justified. Kasper Lippert-Rasmussen here poses the question: "Is affirmative action morally (un)justifiable?" As a phrase that frequently surfaces in major headlines, affirmative action is a highly controversial and far-reaching issue, yet most of the recent scholarly literature surrounding the topic tends to focus on defending one side or another in a particular case of affirmative action. Lippert-Rasmussen instead takes a wide-angle view, addressing each of the prevailing contemporary arguments for and against affirmative action. In his introduction, he proposes an amended definition of affirmative action and considers what forms, from quotas to outreach strategies, may fall under this revised definition. He then analyzes the strengths and weaknesses of each position, relative to each other, and applies recent discussions in political philosophy to assess if and how each argument might justify different conclusions given different cases or philosophical frameworks. Each chapter investigates an argument for or against affirmative action. The six arguments for it consist of compensation, anti-discrimination, equality of opportunity, role model, diversity, and integration. The five arguments against it are reverse discrimination, stigma, mismatch, publicity, and merit. Lippert-Rasmussen also expands the discussion to include affirmative action for groups beyond the prototypical examples of African Americans and women, and to consider health and minority languages as possible criteria for inclusion in affirmative action initiatives. Based on the comparative strength of anti-discrimination and equality of opportunity arguments, Making Sense of Affirmative Action ultimately makes a case in favor of affirmative action; however, its originality lies in Lippert-Rasmussen's careful exploration of moral justifiability as a contextual evaluative measure and his insistence that complexity and a comparative focus are inherent to this important issue.

Few issues are as mired in rhetoric and controversy as affirmative action. This is certainly no less true now as when Ronald J. Fiscus’s The Constitutional Logic of Affirmative Action was first published in 1992. The controversy has, perhaps, become more charged over the past few years. With this compelling and rigorously reasoned argument for a constitutional rationale of affirmative action, Fiscus clarifies the moral and legal ramifications of this complex subject and presents an important view in the context of the ongoing debate. Beginning with a distinction drawn between principles of compensatory and distributive justice, Fiscus argues that the former, although often the basis for judgments made in individual discrimination cases, cannot sufficiently justify broad programs of affirmative action.
