Esta obra tem como objetivo analisar a forma como os juristas romanos, em sua atuação prática, participaram da formação do direito. Não se ignora que boa parte de sua contribuição para a construção do direito romano e, portanto, para o direito ocidental, se deu pelo ensino e pela escrita de obras de doutrina, mas, neste trabalho, optou-se por apreciar essa contribuição pelo fio condutor da atividade consultiva, desdobrada em três aspectos ou tarefas, conforme a definição dada por Cícero no De Oratore: indicar os meios processuais adequados (agere), auxiliar na prática de atos jurídicos (cavere) e responder a questões jurídicas que eram colocadas por particulares ou magistrados (respondere). Desempenhando tais funções, cujas alterações ao longo da história romana são descritas no trabalho por meio do estudo cuidadoso das fontes, os juristas romanos atuaram como artífices e lapidadores de diversos institutos jurídicos, propondo soluções para casos concretos, que, uma vez aceitas, eram replicadas e se tornavam direito estabelecido (ius receptum). Com isso, contribuíram tanto para a criação de novas formas jurídicas, ou seja, para a adaptação do direito a novas necessidades, ampliando o rol de soluções e institutos jurídicos, quanto para a orientação dos atores envolvidos na prática jurídica diária, evitando que as inovações e melhorias ocorressem de forma desordenada e sem vínculo com a tradição. Mantiveram, assim, tanto a vida quanto a coerência da experiência jurídica romana.

En la segunda parte, nos limitamos a enunciar los casos para permitir al lector ejercitarse en su resolución. La metodología que proponemos hace especial hincapié en el proceso de comprensión de las circunstancias del supuesto, de los principios fundamentales de las instituciones en juego y de las consecuencias jurídicas que pudieran derivarse.
