Esta pesquisa discute e contempla a análise da eficácia ou ineficácia dos programas sociais alimentares no município de Imperatriz – Ma, tendo como objeto de análise, o Banco de Alimentos e o Restaurante Popular. Para isso, traçou-se uma trajetória do Direito Humano à Alimentação Adequada, inicialmente pautada na perspectiva histórica dos Direitos Humanos, analisando especificamente o papel fundamental da Organização das Nações Unidas, da Declaração Universal dos Direitos do Homem, do Pacto Internacional dos Direitos Econômicos, Sociais e Culturais, além do Pacto de San Salvador e Declaração de Roma no processo de construção da alimentação como um direito humano no Brasil. Posteriormente a análise se pauta na legislação nacional, embora sejam utilizados a doutrina de Carlos Santiago Nino e Roberty Alexy como autores basilares quando da análise do Direito Humano. A partir das reflexões relacionadas ao Direito Humano à Alimentação Adequada, discute-se igualmente a trajetória da Segurança Alimentar e Nutricional no Brasil, notadamente a trajetória dos instrumentos de garantia à uma alimentação adequada, sendo importante a análise das políticas públicas de combate à fome no Brasil. No que concerne ao Município de Imperatriz – Ma, buscou-se inicialmente a análise do II Plano Nacional de Segurança Alimentar e Nutricional – PLANSAN que estabelece Metas a serem alcançadas pelos Estados e Municípios brasileiros. A partir da análise das Metas constante do II PLANSAN é que se desenvolveu a presente pesquisa. Desta forma, restou necessário a investigação do processo de implementação do Sistema Municipal de Segurança Alimentar e Nutricional no Município de Imperatriz – Ma, bem como a análise de 2 (dois) Programas sociais de políticas públicas de combate à fome, em âmbito municipal, quais sejam, Restaurante Popular e Banco de Alimentos, visando demonstrar através desses programas a importância da atuação do SIMSAN em âmbito municipal quando se trata de combate à fome. Para tanto, a pesquisa foi pautada na análise de leis e doutrinas, tanto na perspectiva do direito internacional quanto no direito brasileiro, a fim de demonstrar a importância do Direito Humano à Alimentação Adequada, também na perspectiva jurídica.
