La justicia en su configuración legal, específicamente penal, es un producto cultural que no debe distanciarse de su justificación ética, debido a su carácter antropológico, que entraña la aspiración más sentida de equidad que tiene la persona y la comunidad. La constitución política de un estado pluriétnico y multicultural, como el Perú, reconoce la jurisdicción de las comunidades nativas y campesinas, como jurisdicción especial, lo cual la integra a la jurisdicción ordinaria, de la misma manera que están integradas las jurisdicciones civil, laboral, de familia, comercial, penal, entre otras especialidades, pese a que dicha jurisdicción tiene los fundamentos filosóficos, antropológicos, sociológicos e históricos necesarios para ser considerada una jurisdicción de excepción, como es el caso de las jurisdicciones militar y arbitral, ambas por respectivas razones sui géneris. En la consecuente coordinación entre la jurisdicción ordinaria y la jurisdicción de las comunidades nativas y campesinas, asoma un direccionamiento ex profeso por parte de aquella sobre ésta, lo cual origina una grave asimetría en el deber del estado de incorporar a dichas comunidades al horizonte de la modernidad, resultando esta coordinación más favorable a los intereses de la justicia ordinaria, la cual está enmarcada en el deficitario e injusto sistema judicial común.

This book is a descriptive grammar of Aguaruna, known to its speakers as Iiniá Chicham, a Jivaroan language spoken by some 55,000 people in the northwest Peruvian Amazon. Aguaruna is typologically and historically significant because of its location in the eastern foothills of the Andes, right between the Andean and Amazonian linguistic areas. Some typologically unusual syntactic phenomena, for example in the areas of grammatical relations and case marking, make this description relevant beyond the areal context. This is the first full grammar of a Jivaroan language, covering phonology, morphology and syntax as well as addressing some issues in discourse structure. This timely study examines the processes by which modern states are created within multiethnic societies. How are national identities forged from countries made up of peoples with different and often conflicting cultures, languages, and histories? How successful is this process? What is lost and gained from the emergence of national identities? Natividad Gutiérrez examines the development of the modern Mexican state to address these difficult questions. She describes how Mexican national identity has been and is being created and evaluates the effectiveness of that process of state-building. Her investigation is distinguished by a critical consideration of cross-cultural theories of nationalism and the illuminating use of a broad range of data from Mexican culture and history, including interviews with contemporary indigenous intellectuals and students, an analysis of public-school textbooks, and information gathered from indigenous organizations. Gutiérrez argues that the modern Mexican state is buttressed by pervasive nationalist myths of foundation, descent, and heroism. These myths--expressed and reinforced through the manipulation of symbols, public education, and political discourse--downplay separate ethnic identities and work together to articulate an overriding nationalist ideology. The ideology girding the Mexican state has not been entirely successful, however. This study reveals that indigenous intellectuals and students are troubled by the relationship between their nationalist and ethnic identities and are increasingly questioning official policies of integration.
