Il volume è diviso in due parti. Nella prima, viene esaminata la fattispecie dell'illecito disciplinare, in particolare sulla base delle decisioni della Corte europea dei diritti dell'uomo, rispetto alle quali non vi è ancora un orientamento chiaro della giurisprudenza domestica, sebbene il tema sia venuto alla ribalta in Italia a seguito del c.d. “caso Grande Stevens” del 2014. L'illecito viene poi ricostruito, nei suoi molteplici aspetti, sulla base della disciplina della legge notarile, secondo l’interpretazione offerta dalle Commissioni regionali di disciplina, dalle Corti d'Appello e dalla giurisprudenza della Cassazione. Particolare attenzione viene riservata all’analisi dell'art. 147 l. n., effettuando una lettura critica della norna, senza limitarsi al mero elenco delle decisioni in materia. La seconda parte dell’opera è dedicata agli aspetti processuali del procedimento disciplinare nella loro completezza, differenziando questo volume dalle pubblicazioni attualmente in circolazione. Il procedimento viene infatti ricostruito dal momento delle ispezioni biennali o dalle indagini dei Consigli distrettuali, trattando poi il procedimento cautelare, quello davanti alla Commissione regionale di disciplina, alla Corte d'Appello, alla Cassazione e il giudizio di rinvio, includendo, infine, il principio di consumazione dell'azione disciplinare, l'esecuzione della sanzione e la riabilitazione del notaio, in modo che il professionista possa trovare i riferimenti pratici e operativi per affrontare ogni fase e questione dell’iter procedimentale. In entrambe le parti viene dato ampio rilievo agli spunti che derivano dall’esame del testo integrale delle sentenze della Cassazione dal 2011 e agli apporti offerti dalla dottrina più significativa.
