Na década de 1820, a Constituição Política da Monarquia Espanhola, a Constituição de Cádiz, era a norma liberal mais representativa da Europa, um continente que via a volta dos monarcas com a restauração. Nesse período, no qual também ocorre a independência do Brasil, a Constituição foi uma grande influência para países europeus e americanos. Essa obra apresenta os influxos dessa Constituição sobre a política e o desenvolvimento constitucional brasileiro e procura mostrar o papel da influência espanhola entre o período de 1820 e 1824 no Brasil. A Constituição de Cádiz influiu sobre diversas normas da Constituição do Império de 1824 e, antes disso, ela fizera parte do imaginário e serviu de inspiração em acontecimentos políticos de grande importância a partir de 1820. A Constituição era uma das obras mais vendidas no Brasil e dela vieram normas sobre as primeiras eleições gerais em 1821, para a transformação de capitanias em províncias e para Constituição que vigorou provisoriamente no Brasil até a independência, as Bases da Constituição da Monarquia Portuguesa. Por exigência de um movimento social, a Constituição chegou até mesmo a ser outorgada no Brasil por uma madrugada, evento rodeado de outros acontecimentos que apontam para a existência de uma sensível influência da norma sobre o início do desenvolvimento do Direito Constitucional brasileiro.

Los procesos constitucionales de España, Portugal y Brasil estuvieron bastante interconectados tras las revoluciones liberales de España, Oporto y el proceso de independencia de Brasil. La Constitución de Cádiz significó una bandera enarbolada en todas las revoluciones del periodo. En estos tres procesos constitucionales buscamos resaltar la relación entre la ciudadanía definida en los textos constitucionales estudiados y el establecimiento de la confesionalidad del Estado. Buscamos establecer la relación de como la declaración de Confesionalidad del Estado restringía la Ciudadanía. Esta misma relación será estudiada específicamente en la Constitución otorgada de 1824 de Brasil. Ahí se adoptó el principio general de concesión de ciudadanía a los “acatólicos”, pero no se admitió el principio de la elegibilidad de éstos, principalmente en las leyes electorales del periodo. Los no católicos se quedaban alejados de una parte del proceso electoral, podían votar pero no ser elegidos para diputados u otros cargos públicos. La discusión iniciada en la Asamblea Constituyente sobre la atribución de la plenitud de los derechos políticos a los no católicos solamente se solucionó al final del siglo XIX con la Ley Saraiva, en donde se admitió el principio de la elegibilidad de los “acatólicos”.
