All'indomani della Liberazione, la Francia ripristina l'ordine repubblicano soppresso dal regime di Vichy. Il ristabilimento della Repubblica non implica tuttavia il ritorno alle istituzioni della Terza Repubblica crollata nel 1940, nel corso della quale si era manifestata una forte instabilità governativa: con il referendum del 21 ottobre 1945, il popolo francese affida a un'Assemblea costituente il compito di elaborare una nuova Costituzione. Le forze depositarie dell'eredità della Resistenza, però, se per un verso si trovano unite nel progettare e attuare un gran numero di riforme strutturali in campo economico e sociale, per l'altro non si rivelano in grado di raggiungere un'intesa sul problema del rinnovamento del sistema politico. Il processo costituente risulta così caratterizzato da una serie di contrapposizioni che hanno come risultato la conclusione di un patto costituzionale debole, che, a differenza ad esempio di quanto avverrà per la Costituzione italiana del 1948, non assume un profondo valore unitario per i partiti che lo siglano. Questo volume ricostruisce, nella loro connessione con la definizione di una forma di Stato sociale, le più importanti ipotesi di riforma del sistema parlamentare che si confrontano e si scontrano in Francia negli anni 1945-1946, e analizza il processo per cui dalle aspirazioni della Resistenza alla creazione di un sistema politico efficiente si giunge, invece, alla fondazione di una Repubblica in cui si riprodurranno alcuni dei principali difetti della Repubblica precedente.
