Pas une réunion professionnelle, pas un cénacle politique, pas une tribune journalistique où il ne soit question, tantôt de réformer la justice, tantôt de réformer l'État, les malaises dénoncés ici, la crise invoquée là, alimentant l'appel à la réforme. Au-delà de l'insatisfaction récurrente des justiciables, le trouble s'est traduit, ces dernières années, par divers mouvements de protestation des professionnels de la justice, les hommes politiques s'estimant, de leur côté, la cible d'une croisade judiciaire. Ce malaise est paradoxal, à plus d'un titre. Nourri de reproches et de revendications qui ne convergent pas nécessairement, il se manifeste alors que l'effort public n'a jamais été aussi important en faveur de l'institution judiciaire, comme la récente loi du 9 septembre 2002 d'orientation et de programmation pour la justice en porte encore témoignage. Mais le débat sur les moyens est un débat à courte vue s'il néglige le débat sur les fins ; la réforme de la justice n'est pas seulement affaire de lois de programme. L'hypothèse de ce livre est que, au-delà des dysfonctionnements matériels, le malaise de la justice pose aujourd'hui la question plus générale de la place de la justice dans l'architecture des pouvoirs étatiques. À l'heure où l'on n'entend plus parler que de gouvernance et de régulation, ce malaise doit être relié aux évolutions dont l'État est lui-même l'objet, taxé d'archaïsme et d'impuissance, invité à se moderniser, sans que l'on sache toujours ce que moderniser veut dire. La réforme de la justice ne peut pas être conçue indépendamment de toute réflexion sur ce qu'est l'État dans la France européenne d'aujourd'hui, le rôle qu'y joue le droit, la part que doit y conserver la politique, la manière dont le droit et la politique peuvent trouver à s'exprimer à travers les activités relevant de ses fonctions législative, exécutive et juridictionnelle. Cette façon de poser les termes du débat entend se démarquer d'une autre conception, qui postule le déclin de l'État et qui investit la justice de toutes les espérances sociétales, une justice promue épicentre de l'État de droit, creuset où s'élabore la démocratie de demain, une justice de services dans un espace public conçu comme une communauté de communautés. Que ce soit sur le terrain des facteurs, sur celui des méthodes ou sur celui des tendances à l'œuvre en matière de réforme de la justice, les contributions qui composent ce livre s'inscrivent dans cette perspective qui situe l'institution judiciaire, en sa double dimension de pouvoir constitué et de service public, au sein de l'appareil d'État.
