Una vez alcanzada la democracia en España y después de la Constitución de 1978, nuestra legislación procesal se ha demorado veinticinco años en adecuarse, con mayor o menor fortuna, a los fines que constitucionalmente justifican la adopción de la medida cautelar de prisión provisional. La obra que se presenta pretende la consecución de tres objetivos: 1. El primero es el llevar a cabo un análisis histórico del tratamiento que se le ha otorgado a la medida cautelar a lo largo de los tiempos en España. A este primer bloque pertenecen los capítulos I a V, en los que se efectúa un recorrido del empleo dado a la institución durante la protohistòria, la Edad Antigua, la Edad Moderna y la Edad Contemporánea. 2. El segundo objetivo es determinar qué importancia ha tenido el Tribunal Constitucional en la configuración de una prisión provisional legítima; por qué ha tardado nuestro país más de dos décadas en acomodar la institución en análisis, de una forma mínimamente aceptable, a la norma fundamental, a pesar de encontrarse durante ese tiempo bajo un régimen político democrático, y qué influencia ha tenido en ello el Consejo de Europa, el Tribunal Europeo de Derechos Humanos y la normativa internacional. A lo expuesto se refiere especialmente el capítulo VI. 3. El último objetivo está relacionado con la Ley Orgánica 13/2003, de 24 de octubre, promulgada tras el anuncio por parte del Tribunal Constitucional, en su Sentencia 47/2000, de la cuestión de inconstitucionalidad de los artículos 503 y 504 de la LECrim. Se ha intentado determinar qué aportaciones ha efectuado dicha norma para la consecución de un modelo de prisión provisional ajustado a cánones de legitimidad y qué mejoras legales serían factibles en un futuro para el mayor logro efectivo de ello. Lo dicho junto con las propuestas que se sugieren para limitar el uso de la prisión provisional a su mínima expresión se desarrolla en los capítulos VII y VIII.
