Mehr als vier Jahre sind mittlerweile seit der Entscheidung des Europäischen Gerichtshofs in der Rechtssache CCOO (Urt. v. 14.05.2019 – C-55/18) vergangen. Passiert ist seitdem nicht viel. Das vorliegende Werk knüpft unmittelbar an die Entscheidung des Europäischen Gerichtshofs an und beleuchtet die wesentlichen Aspekte, die aus dem Urteil für das nationale Recht folgen. Aus europarechtlicher Sicht ist vor allem die Frage relevant, ob bereits zum gegenwärtigen Zeitpunkt (ohne Umsetzung des deutschen Gesetzgebers) eine Verpflichtung zur Arbeitszeiterfassung aus dem europäischen Recht besteht. Anknüpfungspunkte dafür sind vor allem die Arbeitszeitrichtlinie (RL 2003/88/EG) und Art. 31 Abs. 2 GRCh. Nachdem diese Frage verneint werden musste, galt es zu untersuchen, inwieweit das nationale (deutsche) Recht bereits die Anforderungen des europäischen Rechts erfüllt. In diesem Zusammenhang war auch auf die richtlinienkonforme Auslegung des nationalen Rechts einzugehen. Einen Schwerpunkt der Bearbeitung bildeten die Aufgaben und Rechte des Betriebsrates im Zusammenhang mit der Arbeitszeiterfassung. Eine vor allem für die Praxis wichtige Frage stellt sich in Bezug auf die Vereinbarkeit einer umfassenden Arbeitszeiterfassung mit datenschutzrechtlichen Anforderungen. Dabei wurde untersucht, welche Systeme sich für eine Arbeitszeiterfassung besonders eignen und inwieweit die Vorgaben des Europäischen Gerichtshofs damit in Einklang zu bringen sind. Der Spielball liegt jetzt beim Gesetzgeber auf dessen Entscheidung alle gespannt warten.

Was lange als geklart galt und der allgemeinen Meinung entsprach, wird durch eine arbeitsrechtliche Rechtsprechungslinie des EuGH zunehmend in Frage gestellt. Seit seiner Mangold-Entscheidung bejaht der Gerichtshof eine Horizontalwirkung der Unionsgrundrechte und verlasst dabei zunehmend das gewohnte Terrain der "mittelbaren Drittwirkung", wenn er sich inzwischen sogar fur eine unmittelbare Bindung privater Arbeitgeber an die EU-Grundrechte ausspricht. Gleichzeitig umgeht er durch den Ruckgriff auf die Unionsgrundrechte seine standige Rechtsprechung zur fehlenden Horizontalwirkung von Richtlinienbestimmungen. Dieses Vorgehen wirft zahlreiche europa- und verfassungsrechtliche Fragen betreffend die dogmatische Zulassigkeit und die Reichweite dieser Horizontalwirkungsdoktrin im Arbeitsrecht auf. During the middle third of the 20th century, workers in most industrialized countries secured a substantial measure of job security, whether through legislation, contract or social practice.
