Portuguese Abstract: O presente artigo se propõe a (i) expor, brevemente, a forma pela qual são, na teoria e na prática, definidas as “leis aplicáveis” na arbitragem comercial internacional; (ii) enfatizara importância da correta e clara determinação da lei aplicável à clausula arbitral, detalhando, em especial, os recentes paradigmáticos casos sobre o tema; e (iii) delimitar, na medida do possível, e com vistas à preservação da expectativa das partes e da segurança jurídica buscada na arbitragem comercial internacional, (iii.1) as precauções que podem ser tomadas pelas partes no momento de redação do contrato e da cláusula arbitral e (iii.2) como deve ser vista e avaliada, por tribunais arbitrais e judiciais, a questão da lei aplicável à cláusula arbitral quando ela não tiver sido definida pelas partes.
