Os fenômenos da sociedade atual são fenômenos que ensejam novos horizontes de compreensão no contexto brasileiro, especialmente no ramo do Direito. Se por um lado os direitos humanos são pautas permanentes de reivindicações, por outro, emergem reflexões e movimentos referentes aos Direitos dos Animais. É preciso (re) considerar a necessidade da tutela jurídica de animais não-humanos, à luz dos entendimentos globais sobre o tema. O ponto de partida desta obra fundamenta-se em demonstrar que, embora os animais não-humanos não sejam dotados de algumas características semelhantes às dos humanos é imprescindível ampará-los por meio de instrumentos jurídicos, à luz da dignidade e da ética. Almeja-se, nesse sentido, a proteção adequada aos animais, com tutela jurídica eficiente e instrumentos legislativos capazes de salvaguardar seus direitos. Tanto é verdade esta afirmação que o Poder Judiciário, cada vez mais, tem determinado que estes direitos sejam garantidos, à exemplo de decisões históricas que já foram prolatadas pelos Tribunais Superiores brasileiros, e que serão objetos de análise nesta obra. Esta pesquisa justifica-se diante da necessidade de pensar no Direito dos Animais sob outra perspectiva, bem como sua consideração e dignidade, como categorias passíveis de reconhecimento em âmbito social e jurídico. De fato, a fauna, no seu sentido mais amplo, tem amparo constitucional no Brasil. Todavia, para além das disposições constitucionais do artigo 225 da Constituição Federal brasileira e de outros dispositivos legais, como a Lei de Crimes Ambientais, esta pesquisa pretende sustentar argumentos éticos e jurídicos que garantam um novo olhar aos direitos dos animais no momento presente. Para tanto, divide-se a obra em três partes distintas. A primeira aborda a questão do especismo e de que modo esta categoria influencia diretamente na exploração institucionalizada dos animais não-humanos desde os primórdios da civilização. Na ótica especista, os animais servem para fins essencialmente utilitários, e, por este motivo, são utilizados de maneira conveniente para atingir interesses dos humanos, seja para alimentação, vestuário, entretenimento, ciência, dentre outros. A segunda parte tem como proposta refletir sobre a forma como os animais não-humanos são tratados sob o prisma jurídico no Brasil. Atualmente, as normas positivadas possuem um viés antropocêntrico, ou seja, a única preocupação é com o ser humano. Todavia, gradativamente, percebe-se um anseio social por mudanças no status jurídico dos animais. Nesse sentido, já é possível encontrar decisões judiciais concedendo garantias aos animais que, tempos atrás, jamais se imaginava, como por exemplo, o habeas corpus. Serão apresentados argumentos éticos, filosóficos e jurídicos a favor dos Direito dos Animais que, numa análise histórica, são praticamente desconsiderados. Nos últimos anos, porém, mudanças de pensamento no contexto social influenciam uma nova perspectiva, onde estes direitos necessitam ser reconhecidos e garantidos pelo ordenamento jurídico, como o direito à vida, à integridade física e a liberdade de viver em seu habitat natural. Apesar da relevância do tema, ainda existem resistências contra a tutela dos animais e seus direitos. Sendo assim, o objetivo desta pesquisa é demonstrar a importância do reconhecimento dos Direitos dos Animais como titulares de direitos, buscando atender aos anseios da sociedade atual.

Infinite regress arguments are part of a philosopher's tool kit of argumentation. But how sharp or strong is this tool? How effectively is it used? The typical presentation of infinite regress arguments throughout history is so succinct and has so many gaps that it is often unclear how an infinite regress is derived, and why an infinite regress is logically problematic, and as a result, it is often difficult to evaluate infinite regress arguments. These consequences of our customary way of using this tool indicate that there is a need for a theory to re-orient our practice. My general approach to contribute to such a theory, consists of collecting and evaluating as many infinite regress arguments as possible, comparing and contrasting many of the formal and non-formal properties, looking for recurring patterns, and identifying the properties that appeared essential to those patterns. Two very general questions guided this work: (1) How are infinite regresses generated in infinite regress arguments? (2) How do infinite regresses logically function as premises in an argument? In answering these questions I clarify the notion of an infinite regress; identify different logical forms of infinite regresses; describe different kinds of infinite regress arguments; distinguish the rhetoric from the logic in infinite regress arguments; and suggest ways of improving our discussion and our practice of constructing and evaluating these arguments.

Arguing that our attachment to Aristotelian modes of discourse makes a revision of their conceptual foundations long overdue, the author proposes the consideration of unacknowledged factors that play a central role in argument itself. These are in particular the subjective imprint and the dynamics of argumentation. Their inclusion in a four-dimensional framework (subjective-objective, structural-procedural) and the focus on thesis validity allow for a more realistic view of our discourse practice. Exhaustive analyses of fascinating historical and contemporary arguments are provided. These range from Columbus’s advocacy of the Western Passage to India, over the trial of King Louis XVI during the French Revolution, to today’s highly charged controversies surrounding euthanasia and embryo research. Excavating foundational issues such as the purpose of argument itself (assent of an audience or critical examination of validity claims) and the contested role of argument as a generator of knowledge, the book culminates in a discussion of the relationship between rationality and reasonableness and criticizes the restrictions of ‘rational’ argument relying on fixed logical, economic or cultural criteria that in reality are mutable.
