El Código Civil de Andrés Bello es un código autóctono de América Latina, el cual recogió las reglas de nuestra tradición jurídica, apoyadas en los principios generales del derecho, que luego fueron perfiladas y maduradas con el fin de responder a nuestra experiencia como latinoamericanos. Es un código que ha pervivido debido a su claridad, precisión y concisión en su redacción, así como por la forma institucional que presenta las figuras que rigen las relaciones de los privados. Sin embargo, el Código se construye con base en una mentalidad, un método y unas circunstancias universales y nacionales diferentes alas de hoy, lo cual nos con-lleva a reflexionar si dichas reglas responden a los desafíos de la sociedad contemporánea. En especial, cuando existe un movimiento reformador influenciado por las recientes reformas de códigos civiles en el mundo, como lo son, por ejemplo, la reforma del Código Civil francés de 2016 y la expedición del Código Civil y Comercial de la República Argentina en 2015. El presente libro es el esfuerzo de profesores investigadores que han analizado la vigencia del Código Civil de Andrés Bello en el sistema jurídico latinoamericano, pero a través de algunas reglas contenidas en dicho Código, en atención a las particularidades de las relaciones privadas actuales y a los nuevos contextos y realidades sociales y económicas. Para cumplir con el objetivo de análisis, el libro se divide en cuatro partes: la primera trata sobre la vigencia del Código Civil de Andrés Bello en el sistema jurídico latinoamericano y algunas experiencias de reforma en Colombia; la segunda trata sobre el derecho de familia en el Código Civil de Andrés Bello en la sociedad contemporánea; la tercera analiza la interpretación e integración del contrato en el Código Civil de Andrés Bello a la luz de los nuevos retos de la contratación; y finalmente, la cuarta trata sobre los regímenes de responsabilidad civil frente a los retos de la sociedad moderna, para lo cual se estudian dos casos particulares, la responsabilidad por las actividades peligrosas y la responsabilidad de los empresarios por el hecho de los dependientes. Así, en la primera parte se pone en evidencia el modelo institucional del Código Civil de Andrés Bello y su utilidad: es un código en el que la persona tiene un rol central, y los institutos se presentan de forma didáctica y comprensible, todo lo cual hace que se convierta en un modelo referente al momento de estudiar el derecho privado con sus retos, y en caso de que se quiera reformar, tenerse en cuenta en los trabajos de preparación del eventual proyecto de nuevo código.
