O presente estudo trata dos conflitos que envolvem o processo formador de uma nova identidade da mulher, a partir da construção da sua autonomia privada decisória e o consequente empoderamento. Objetiva analisar as várias formas de discriminação e violência pelas quais, as mulheres por anos ficaram submetidas, cujos costumes ainda remanescem nas conjunturas sociais e privadas, ainda que não tão acentuadamente como na forma inicial da história da vida humana. Partindo de uma realidade comum vivenciada nos âmbitos privados, as mulheres reúnem-se para, por meio de lutas, movimentos sociais e feministas serem inseridas no trabalho, na política, na educação e em todos os setores sociais e desta forma alterar as legislações e proteções constitucionais dos direitos inerentes à personalidade em situação de igualdade entre homens e mulheres, cujas transformações afetariam as estruturas familiares. Apresenta-se o estudo que se inicia pelas várias formas de violência e submissão que a mulher sofria, cujos atos e comportamentos de reprimenda eram calcados sob o manto de proteção legal, institucional e no poder patriarcal. Destacamos vários fatos históricos de violência e as lutas das mulheres na busca por legislações que lhes concedessem direitos e proteções legais que marcaram nossos dias; as transformações sociais e legislativas acompanharam as mutações sociais atingindo inclusive os tribunais superiores destacando-se a ADI 4.424/DF e ADC 19/DF, propostas conjuntamente no STF, com o intuito de acabar com interpretações divergentes quanto a Lei 11.340/2006(Lei Maria da Penha) no julgamento de casos de violência contra a mulher no ambiente doméstico e familiar, cuja decisão tratou a violência doméstica como sendo de natureza incondicionada da ação penal, pouco importando sua extensão. A mulher além das proteções legais desejava ser ela mesma, autoafirmar-se, ser livre, independente, empoderar-se, ter sua autoestima respeitada, ter sua própria identidade, simplesmente "ser mulher". O "empoderamento" em nada afeta o direito de outrem, trata-se de uma superação própria, uma conquista autônoma sem atingir nenhum direito alheio a não ser o seu próprio, significa superar-se, lutar, atingir, conseguir, ter suas próprias características, suas próprias formas de expressão e de posição social, familiar, pessoal. Essa identidade pessoal e social conjugada com seu poder aquisitivo pelo seu ingresso no trabalho e de liberdade de escolhas quanto à maternidade e ao casamento colaborou para alterar, transformar e abalar as estruturas familiares, até então tidas como imutáveis. A mulher buscou um lugar para suas escolhas e suas aspirações livres, não com a canalização de modelos sociais, mas o poder de autodeterminação e de indeterminação subjetiva, com liberalização na esfera da sexualidade e nas suas escolhas familiares, impondo assim aos seus membros, um caminho de escolhas e atribuição de papéis e responsabilidades, encaminhando para a formação de novos arranjos familiares e das não tradicionais composições familiares, que também necessitou de adaptação legal para suas proteções. O presente Estudo está alocado no âmbito do Programa de Mestrado em Direito da UNOESC, área de concentração Dimensões Materiais e Eficácias dos Direitos Fundamentais, na Linha de Pesquisa Direitos Fundamentais Civis. O trabalho foi desenvolvido por meio de pesquisa bibliográfica relacionada aos ramos do direito e história. O método científico utilizado foi o dedutivo comparado.

This book reconsiders the dominant Western understandings of freedom through the lens of women's real-life experiences of domestic violence, welfare, and Islamic veiling. Nancy Hirschmann argues that the typical approach to freedom found in political philosophy severely reduces the concept's complexity, which is more fully revealed by taking such practical issues into account. Hirschmann begins by arguing that the dominant Western understanding of freedom does not provide a conceptual vocabulary for accurately characterizing women's experiences. Often, free choice is assumed when women are in fact coerced--as when a battered woman who stays with her abuser out of fear or economic necessity is said to make this choice because it must not be so bad--and coercion is assumed when free choices are made--such as when Westerners assume that all veiled women are oppressed, even though many Islamic women view veiling as an important symbol of cultural identity. Understanding the contexts in which choices arise and are made is central to understanding that freedom is socially constructed through systems of power such as patriarchy, capitalism, and race privilege. Social norms, practices, and language set the conditions within which choices are made, determine what options are available, and shape our individual subjectivity, desires, and self-understandings. Attending to the ways in which contexts construct us as "subjects" of liberty, Hirschmann argues, provides a firmer empirical and theoretical footing for understanding what freedom means and entails politically, intellectually, and socially.
