Resultado da minha dissertação de mestrado em Direito Público, defendida em 2020 na Universidade FUMEC, em Belo Horizonte, este livro visa compreender como os órgãos de controle externo aplicam multas, notadamente aquelas emanadas pelo Tribunal de Contas da União (TCU) e pelo Tribunal de Contas do Estado de Minas Gerais (TCEMG), que considero possuírem o condão de sintetizar a realidade brasileira, pela quantidade de controlados que abrangem e porque participam ativamente do controle de receitas e despesas (recursos da União, Estados e municípios) de diversos cantos do Brasil. Para tanto, fundamento-me numa perspectiva do direito administrativo sancionador que suplanta a noção de que a penalidade deva ser imputada pela simples ilegalidade praticada por seu infrator, atrelada às teorias dissuasórias com vistas a prover a boa governança e a accountability dos controlados. As sanções aplicadas pelos tribunais de contas, segundo doutrina majoritária e a jurisprudência pátria, possuem natureza administrativa, motivo pelo qual é relevante aprofundar no tema, desde uma retrospectiva histórica do direito administrativo sancionador. A obra está dividida em quatro capítulos e as considerações finais. Optei por dispor as notas ao fim de cada capítulo, de modo a tornar a leitura mais fluida e ao mesmo tempo facilitar a consulta.

O princípio da proibição do excesso ou da proporcionalidade clássica é considerado por muitos o mais importante princípio do Direito Constitucional gerado pelas perspetivas pós-positivistas do direito e o centro da dogmática dos direitos fundamentais. A sua universalidade tem-se acentuado, sendo visto como um dos pilares do vocabulário comum de um constitucionalismo global. Em Portugal, a Constituição consagra-o, tendo sido, aliás, um dos primeiros textos constitucionais a referir-se-lhe expressamente. O Tribunal Constitucional aplica-o com regularidade. O presente estudo demonstra que o princípio da proibição do excesso tem conteúdo, estrutura e metódica aplicativa variáveis consoante seja encarado como norma de ação dirigida ao legislador ou como parâmetro de controlo ao dispor do juiz constitucional.
