O campo de estudos sobre as políticas públicas evoluiu ao longo dos séculos XX e XXI de modo reflexivo aos movimentos pendulares de maximização e minimização do tamanho do Estado nos contextos nacionais, apresentando um conjunto peculiar de instrumentos teórico-metodológicos multidisciplinares com finalidades não apenas descritivas, mas também prescritivas em uma realidade permeada pela complexidade. Partindo de reflexões do campo de Políticas Públicas, a presente obra, intitulada “As Políticas Públicas frente à Transformação da Sociedade 2”, configura-se por robusta coletânea de pesquisas empíricas relacionadas às áreas de Educação e Saúde, as quais possuem ricas e diferenciadas abordagens por meio de recortes metodológicos e teóricos próprios, demonstrando assim a riqueza do campo de estudos de políticas públicas. Estruturado em 22 capítulos, o livro é o fruto de um trabalho coletivo de um perfil plural de profissionais comprometidos com os estudos empíricos de políticas públicas, o qual é caracterizado pelas distintas experiências de 48 pesquisadoras e 13 pesquisadores oriundos, nacionalmente, de todas macrorregiões brasileiras (Sul, Sudeste, Centro-Oeste, Nordeste e Norte), e, internacionalmente, da Colômbia. A organização desta obra obedeceu a um sequenciamento temático, de modo que apresenta uma panorâmica visualização das mais clássicas políticas sociais por meio, respectivamente, um eixo de discussões sobre políticas públicas relacionadas à Educação nos primeiros 12 capítulos, e um segundo eixo temático de discussões na área de Saúde nos 10 capítulos seguintes. No primeiro eixo, a temática educacional é explorada por meio de capítulos que versam sobre assuntos variados, como política educacional nacional, ensino básico, ensino médio e ensino superior, representações visual e de competências linguístico-comunicativas, enfoques gerenciais na educação, equipes multidisciplinares e monitoria colaborativa no contexto educacional. No segundo eixo, a Saúde é explorada desde enfoques macroanalíticos que exploram políticas nacionais específicas, gestão na Saúde Pública zika vírus no Brasil ou sobre o Sistema Único de Saúde (SUS) até se chegar a enfoques microanalíticos de estudos de casos em ambiente hospitalar ou em unidades sanitárias ou mesmo sobre participação discente em diferentes estados brasileiros. Since the end of the Second World War and the subsequent success of constitutional judicial review, one particular model of constitutional rights has had remarkable success, first in Europe and now globally. This global model of constitutional rights is characterized by an extremely broad approach to the scope of rights (sometimes referred to as 'rights inflation'), the acceptance of horizontal effect of rights, positive obligations, and increasingly also socio-economic rights, and the use of the doctrines of balancing and proportionality to determine the permissible limitations of rights. Drawing on analyses of a broad range of cases from the UK, the European Court of Human Rights, Germany, Canada, the US, and South Africa, this book provides the first substantive moral, reconstructive theory of the global model. It shows that it is based on a coherent conception of constitutional rights which connects to attractive accounts of judicial review, democracy and the separation of powers. The first part of the book develops a theory of the scope of rights under the global model. It defends the idea of a general right to personal autonomy: a right to everything which, according to the agent's self-conception, is in his or her interest. The function of this right is to acknowledge that every act by a public authority which places a burden on a person's autonomy requires justification. The second part of the book proposes a theory of the structure of this justification which offers original and useful accounts of the important doctrines of balancing and proportionality.
