O professor Canotilho já teve oportunidade de dizer que o fenômeno da corrupção, que já teve como epicentro fático e normativo subornar alguém por dinheiro, sofre hoje do que ele chama de transvase, isto porque, por excesso de liquido ou por defeito de vasos jurídicos, ele transborda de complexos fáticos para outros complexos fáticos, ganhando densidade simbólica e real em níveis de expansão incomensuráveis, causando dispersões dogmáticas sob o ponto de vista do seu enfrentamento muito perigosas. Este problema cultural também é histórico, como abordamos em nosso trabalho sobre patologias corruptivas, e por isto temos sustentado que a corrupção tem múltiplos impactos detrimentosos na vida das pessoas (físicas e jurídicas), em especial naquelas que dependem de recursos (públicos e privados) para subsidiar o desenvolvimento humano digno, não sofrendo da mesma forma grupos e segmentos sociais mais abastados sob o ponto de vista econômico. Ela não somente afeta o crescimento econômico do Mercado, desencorajando investimentos, mas ataca de forma direta e indireta os mais pobres, trazendo dificuldades à geração de políticas públicas que propiciem o atendimento de suas demandas mais básicas, desviando recursos orçamentários dos investimentos em infraestrutura e estratégias cruciais para que saiam daquela condição. A abordagem do Prof. Márcio Notari neste livro perpassa também estes temas e muitos outros mais, razão pela qual desejamos a todos uma boa leitura.

The recently-adopted OECD convention outlawing bribery of foreign public officials is welcome evidence of how much progress has been made in the battle against corruption. The financial crisis in East Asia is an indication of how much remains to be done. Corruption is by no means a new issue but it has only recently emerged as a global issue. With the end of the Cold War, the pace and breadth of the trends toward democratization and international economic integration accelerated and expanded globally. Yet corruption could slow or even reverse these trends, potentially threatening economic development and political stability in some countries. As the global implications of corruption have grown, so has the impetus for international action to combat it. In addition to efforts in the OECD, the Organization of American States, the World Trade Organization, and the United Nations General Assembly, the World Bank and the International Monetary Fund have both begun to emphasize corruption as an impediment to economic development. This book includes a chapter by the Chairman of the OECD Working Group on Bribery discussing the evolution of the OECD convention and what is needed to make it effective. Other chapters address the causes and consequences of corruption, including the impact on investment and growth and the role of multinational corporations in discouraging bribery. The final chapter summarizes and also discusses some of the other anticorruption initiatives that either have been or should be adopted by governments, multilateral development banks, and other international organizations.

The first version of this Source Book argued the case for a "National Integrity System", an holistic approach to transparency and accountability and embracing a range of accountability "pillars", democratic, judicial, media and civil society. The fight against corruption is not wholly a moral one, in the sense that it is a struggle against the intrinsic "evil" of corruption. But the compelling reason for the struggle is the suffering and deprivation corruption brings to whole societies, and to the world's most poor.
