Judicial Dispute Resolution written by Lawrence Susskind and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-04-11 with Law categories.

This book describes the ways in which judges, using judicial dispute resolution (JDR), have been facilitating problem-solving among litigants, and in the process ensuring more just outcomes. JDR is similar to mediation, alternative dispute resolution (ADR), as it is sometimes called, but it is provided by a judge, not a private mediator. Very little has been written about JDR, especially in Canada where it has been pioneered for several decades, because all the records have remained confidential. The story can now be told because the authors were given exclusive access to the records and the parties (including the JDR judges) in nine illustrative cases. The authors provide a complete Teaching Appendix summarizing the JDR cases from the standpoint of a variety of legal specialties, while highlighting the differences between JDR and ADR.

Defendants And Victims In International Criminal Justice written by Juan Pablo Perez-Leon-Acevedo and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-04-29 with Law categories.

This volume considers a variety of key issues pertaining to the rights of defendants and victims at International Criminal Courts (ICTs) and explores how best to balance and enhance the rights of both in order to ensure the effectiveness and efficiency of international criminal proceedings. The rights of victims are becoming an increasingly important issue at ICTs. Yet, at the same time, this has to be achieved without having a detrimental impact upon on the rights of the defence and the efficiency of the courts. This book provides analyses of issues on the rights of both the accused and the victims. By discussing matters concerning these two pivotal actors in international criminal justice within the same volume, the work highlights that there are intrinsic and intense conflicting and converging relationships between victims and the accused, particularly in terms of their rights. While most of the chapters focus mainly on either the accused or the victims, others discuss both at the same time. The work strikes a fine balance between, on the one hand, classic topics on the rights of the accused and the rights of the victims and, on the other, topics which have been largely unexplored and/or which require new angles or perspectives. Additionally, there are some chapters which approach both the rights of the accused and the rights of the victims in new contexts and/or under novel perspectives. The book as a whole provides a discussion of the two sides of this important coin of international criminal justice. The work will be an essential resource for academics, practitioners and students with an interest in the field of international criminal law. It will also be of interest to human rights scholars who are working with the rights of victims and the accused.

In 1945, when southern segregationist Judge J. Waties Waring turned civil rights activist, he became the first jurist in modern times to declare segregated schooling "inequality per se." Throughout his career he also ordered the equalization of teachers' salaries, outlawed South Carolina's white primary, and urged the complete breakdown of state-enforced bars to racial intermingling. Yarbrough examines the life and career of this fascinating but neglected jurist, assessing the controversy he generated and his place in the early history of the modern civil rights movement.

"Globalization has unleashed new health threats, connecting societies in shared vulnerability to common challenges, including infectious disease, non-communicable disease, environmental pollution, injuries, and inequitable poverty. The COVID-19 pandemic has made clear the cataclysmic health threats of a rapidly globalizing world and the limitations of domestic law and policy in addressing economic, social, and political determinants of health. No country acting on its own can stem major health hazards that go well beyond national borders. Where national laws cannot reach threats beyond national borders, global law is necessary to promote health and justice. If globalization has presented global challenges to disease prevention and health promotion, global health law offers the promise of bridging national boundaries to promote health and reduce health inequities"--

This book documents some of the pacifist and social justice convictions of early Pentecostals, many of whom were called traitors, slackers, cranks, and weak-minded people for extending Jesus' love beyond racial, ethnic, and national boundaries. They wrestled with citizenship and Jesus' prohibitions on killing. They rejected nation-worship, war profiteering, wage slavery, patriotic indoctrination, militarism, and Wall Street politics--and many suffered for it. They criticized governments and churches that, in wartime, endorsed the very thing forbidden in their sacred book and civil laws. They recognized the dangers of loving your country too much, even more than Jesus and his words, and viewed nation-loyalty as a distraction from a higher and more inclusive loyalty--devotion to God. These articles, once accessible only to academics, are now available to the public. These voices, often forgotten within today's mainstream Pentecostal history, offer an opportunity to revisit the passions of early Pentecostal leaders and to examine Pentecostalism in fresh ways.
