A presente obra dá enfoque às crianças e adolescentes institucionalizados de forma precoce e prolongada, bem como as principais consequências deste instituto, tais como a falta de pertencimento dos acolhidos, a despreparação para o convívio no meio social, a inserção e a reiteração na vida criminosa. Diante disso, buscou-se apresentar os desafios das políticas de atendimento infanto-juvenis, de acordo com uma perspectiva histórica e cultural, desde as primeiras décadas do século XVIII até a aplicação das medidas socioeducativas de internação – como meio de privativo de liberdade – previstas pelo Estatuto da Criança e do Adolescente (ECA) e reiteradas pelo Sistema Nacional de Atendimento Socioeducativo (SINASE). As determinações da criminalização após o processo de institucionalização têm como fonte a perda de pertencimento dos sujeitos acolhidos, fragilizando assim as possibilidades destes em encontrarem sentido e perspectivas para o futuro. As condições e o modo de vida das crianças e adolescentes retratam a vulnerabilidade e o fator de risco social, a desfiliação (devido ao afastamento gerado entre a criança e a família natural), a falta de base educacional e qualificação para o trabalho. Com isso, abrem-se as portas das drogas e do mundo criminoso, como forma ilusória de aliviar o sofrimento, experimentar novas formas de interação, adquirir visibilidade e o tão sonhado pertencimento. Na esfera privada – qual seja as relações familiares e do contexto social próximo – os adolescentes vivenciam a ruptura de vínculos e carecem da intervenção do Estado quanto à efetivação de políticas públicas que fomentem a resiliência. Os adolescentes reincidentes, além disso, passam despercebidos pelas estruturas do Estado ou são excluídos por não corresponderem aos padrões de comportamento desejado (ou esperado), dado o problema dos estigmas ou rótulos sociais criados pela sociedade. Assim, apesar dos progressos conceituais acerca dos direitos e garantias infanto- juvenis, preponderam práticas punitivas em detrimento ao caráter socioeducativo das medidas, perdendo totalmente o sentido para os jovens. O abrigo se torna a moradia do acolhido. A estrutura desse ambiente é precária. O tratamento não se torna individualizado. O Sistema reforça a história de segregação e desqualificação social. O rótulo da reincidência funciona como um condutor para a focalização cada vez maior do Sistema de Atendimento em medidas repressivas, que corroboram a manutenção do adolescente no status que lhe é atribuído.

No Brasil, um dos marcos nas políticas públicas para crianças e adolescentes se dá em meados dos anos 90 com a aprovação do Estatuto da Criança e do Adolescente (ECA), Lei n. 8.069, de 13 de julho de 1990. A aprovação da Lei n. 8.069 institui a proteção integral à criança e ao adolescente, prevendo direito à vida, à saúde, à educação, à cultura, ao esporte e ao lazer, mediante a efetivação de políticas públicas que assegurem os direitos. O Artigo 5º prevê que “nenhuma criança ou adolescente será objeto de qualquer forma de negligência, discriminação, exploração, violência, crueldade e opressão, punido na forma da lei qualquer atentado, por ação ou omissão aos seus direitos fundamentais “(BRASIL. LEI Nº 8.069, 1990). É importante referir que a Lei n º 8.069 de 1990, foi criada considerando os direitos previstos na Constituição Federal da República promulgada em 1988, dos quais um dos princípios fundamentais é a garantia a cidadania. Portanto, cabe ao Estado garantir que os direitos previstos em lei sejam assegurados em sua integralidade. Ainda, vale ressaltar que a existência da lei por si só, não garante a totalidade do cumprimento do que nela está disposto. No artigo 3º do Estatuto da Criança e do Adolescente está previsto que “[…] a criança e o adolescente gozam de todos os direitos fundamentais inerentes à pessoa humana, sem prejuízo da proteção integral de que trata esta Lei, assegurando-se-lhes, por lei, ou por outros meios, todas as oportunidades e facilidades, a fim de lhes facultar o desenvolvimento físico, mental, moral, espiritual e social, em condições de liberdade e de dignidade” (BRASIL. LEI Nº 8.069, 1990). No cenário social brasileiro vamos destacar duas instituições responsáveis por implementar políticas públicas à criança e ao adolescente, a saber: escolas e instituições do sistema socioeducativo. Assim, os textos do livro Educação e Socioeducação sugerirão reflexões do contexto escolar e do contexto da socioeducação. A escola é socialmente uma instituição que desde anos é legitimada como a detentora do conhecimento e a responsável pela formação do ser humano. A Socioeducação se define hoje como a mais importante política pública para os adolescentes considerados autores de atos infracionais. Conforme os normativos legais, especialmente a Lei nº 8.069/1990, que dispõe sobre o Estatuto da Criança e do Adolescente (ECA) e a Lei nº 12.594/2012, que institui o Sistema Nacional de Atendimento Socioeducativo (SINASE), o foco do trabalho realizado no sistema socioeducativo é para ressocializar o adolescente por meio de práticas educacionais implementadas nas seis medidas educativas, a saber: advertência; obrigação de reparar o dano; prestação de serviço à comunidade; liberdade assistida; semiliberdade e internação em estabelecimento educacional. Portanto, os autores integrantes deste livro apresentam análise da escolarização e socioeducação, uma vez que permite estabelecer relação com o previsto na Lei 8.069/1990, especialmente no que concerne a proteção integral à criança e ao adolescente Desejo boa leitura e boas reflexões!

O presente estudo teve como objetivo geral considerar os processos sociais envolvidos na situação do adolescente em conflito com a lei no Brasil, suas implicações na transformação de histórias de vidas e consequente demandas nos programas de atendimento. De forma mais específica objetivou trazer conhecimentos concretos para o campo de trabalho socioeducativo, e investigar aquilo que se apresenta como propiciador da reincidência. O que leva o/a adolescente a infracionar novamente? Os dados coletados, considerando as medidas socioeducativas, demonstram que elas não dão conta do objeto ao qual se propõem: o rompimento com o ciclo da delinquência, com a repetição do ato de delinquir. A forma como as medidas estão sendo propostas são reguladoras muito externas, e não estão entrando no cerne do problema. Nesse sentido, devem considerar os sentimentos de raiva e ódio que movem o adolescente. No subtexto dessa raiva existem situações de humilhação e sentimentos de vergonha que, por não serem elaborados, criam um ciclo humilhação – vergonha – ódio. Entra-se num círculo odioso, retroalimentado, que supõe a raiva, a dimensão que o prazer de delinquir tem, ao que eles chamam de adrenalina.

This book presents the results of researches conducted with children and youth at risk for over 20 years in Brazil. It addresses a series of topics related to children and youth living in poverty or in situations of social vulnerability, such as family, sexual and dating violence; adolescent mothers and mothers who put their children for adoption; children and youth living in foster and institutional care; and adolescents involved in drug trafficking or incarcerated in juvenile detention centers. This book presents an innovative method to improve workers’ health and prevent occupational accidents: the Change Laboratory, a method of formative intervention that enables the organization's participants to identify, with the help of facilitators, the historical and systemic origins of work processes anomalies (environmental problems, work safety and health, quality and productivity problems, problems related to labor relations, etc). It proposes a cycle of expansive learning that evolves from recognition of the problem to the visualization, testing and consolidation of solutions. The Change Laboratory method was first developed by Finnish researchers in the 90s and has been improved since then by an international network of research centers in ten countries. This volume presents the results of the experiences conducted by the Brazilian research group to apply the methodology to workers’ health programs. It adopts a translational approach and seeks to elaborate a method of intervention that goes beyond the mere diagnostics to present solutions to concrete problems based on systematized and participatory research.
