O livro, fruto de pesquisa para tese de Mestrado em Direito Público, tem como objetivo mapear as atividades exercidas pela Agência Nacional de Transportes Terrestres (ANTT), no exercício de sua competência sancionatória e fiscalizadora, sob as concessionárias privadas de rodovias federais durante os anos de 2005 a 2017. O estudo parte da análise do regime jurídico aplicável às concessões das rodovias federais brasileiras, perpassando pela identificação e delineamento do regramento extracontratual criado pela Agência Reguladora, bem como as cláusulas contratuais construídas ao longo das 3 etapas do PROCROFE (Programa de Concessões de Rodovias Federais) com especial foco naquelas que versem sobre os mecanismos de sanções administrativas. A partir disso, em confronto com informações cedidas pela ANTT, pretende-se averiguar a hipótese do exercício de atividade sancionatória, inclusive com criação de tipificações de infrações contratuais, pela Agência Reguladora à margem da relação contratual com os concessionários para, ao final, sugerir redação de cláusula contratual que verse sobre as sanções administrativas aplicáveis aos contratos de concessão de rodovias federais.
