Inhaltsangabe:Einleitung: The music industry is a $ 100 billion industry trapped in a $ 40 billion body. Dieser Satz umschreibt am besten die Euphorie innerhalb und außerhalb der Musikindustrie, die im wesentlichen mit dem Auftreten von zwei technischen Entwicklungen ausgelöst wurde. Die eine war das Internet und die andere die Entwicklung von Kompressionsformaten, welche die ursprüngliche Größe von Musikdaten drastisch reduzierten und damit die Möglichkeit boten, Musik über Datennetze zu verbreiten. Die traditionelle Musikindustrie hat die neuen Möglichkeiten und vor allem die Geschwindigkeit dieser Entwicklung vollkommen unterschätzt. Zwar hat sich die Tonträgerindustrie schon früh in ersten Projekten engagiert und sich auch der MP3-Technologie, dem bekanntesten der Musikkompressionsformate, angenommen, die großen Tonträgerhersteller wie bspw. Bertelsmann Music Group oder Universal Music Group aber haben nur zögerlich ihre Musikinhalte zur Verfügung gestellt. Unternehmen wie MP3.com oder Emusic, die einige Jahre zuvor noch nicht existierten, wurden zu Medienstars. Diese ermöglichten unabhängigen Künstlern und Tonträgerherstellern, ihre Musik über das Internet zu verbreiten, und lösten dadurch, zumindest an der Börse, wahre Begeisterungsstürme aus. Nicht nur das Erscheinen von Musiktauschbörsen wie Napster und die damit verbundenen Urheberrechtsverletzungen haben dem kommerziellen Vertrieb von Musik über Datennetze erstmals einen Rückschlag versetzt. Die meisten erkannten auch erst spät, daß ohne die großen Tonträgerhersteller und deren Musikrepertoire eine breite Vermarktung und ein wirtschaftlicher Erfolg von Musik im Internet nicht möglich sei. Die vorliegende Arbeit zeigt, wie die neuen technischen Möglichkeiten bei der Gestaltung eines neuen, digitalen Vertriebswegs für Musik eingesetzt werden können und die Auswirkungen auf die bestehenden Vertriebswege bzw. auf deren Akteure. Letzteres ist nötig, da die Entwicklung eines digitalen Vertriebswegs nicht isoliert von den bestehenden Vertriebswegen betrachtet werden kann. Gang der Untersuchung: In Kapitel 2 werden die traditionellen Strukturen der Musikindustrie erarbeitet und die beteiligten Akteure vorgestellt. Because there are no market imperfec tions (other than government-created or trade-union-generated monopolies), the market can be trusted to regulate economic activity, inexorably meting out appropriate rewards and punishments. In this ideal world, corporate size and power can be safely ignored. After all, corporations become big only only because they are efficient, only because they are productive, only because they have served consumers better than their rivals, and only because no newcomers are good enough to challenge their dominance. Once an industrial giant becomes lethargic and no longer bestows its productive beneficence on society, it will inevitably wither and eventually die. This is the "natural law" that governs economic life. It demands obedience to its rules. It tolerates no interference by the state.
